ORDER by Magistrate Judge Mark D. Clarke: Defendants move for a stay of discovery pending the Court's ruling on a separate Motion for Reconsideration of the Court's preliminary injunction in this case. Defendants assert that moving forward with discovery could lead to disclosure of otherwise confidential health, disciplinary, PREA complaint, and grievance information of AICs who have not affirmatively joined the putative class or agreed to release such information. However, the Court has already entered a Protective Order (ECF No. 53 ), allowing for discovery to be exchanged and maintained as "Confidential" and "Attorneys' Eyes Only." Defendants orally moved for a stay of the preliminary injunctive relief granted in the Court's Amended Preliminary Injunction, as well as a stay of discovery, pending their planned interlocutory appeal. Both oral motions are DENIED. Plaintiffs orally moved to compel production of discovery that personally identifies the transgender inmates in ODOC custody, which has so far been withheld or redacted by Defendants.
