On July 14, 2026, two counties, a reproductive health nonprofit, and a sexuality education advocacy organization filed this lawsuit in the U.S. District Court for the District of Columbia. The plaintiffs sued the U.S. Department of Health and Human Services (HHS) and its Secretary in his official capacity, asserting violations of the Administrative Procedure Act (APA) and First Amendment. Represented by Democracy Forward, the plaintiffs alleged that HHS unlawfully replaced the evidence-based Teen Pregnancy Prevention Program (TPP) with a 2026 Policy that imposed new funding conditions, including abstinence-only education mandates, prohibitions on "gender ideology," and restrictions on discussions of teen sexual activity. The plaintiffs sought declaratory and injunctive relief barring the defendants from enforcing the 2026 Policy, a vacatur of the 2026 Policy, and attorney’s fees. The case was assigned to District Judge Christopher R. Cooper.

On July 15, 2026, the plaintiffs filed a motion for a 5 U.S.C. § 705 stay and preliminary injunction. They argued that they were likely to succeed on the merits, that they would face irreparable harm absent relief, and that the balance of equities and public interest weighed in their favor. 

On August 19, 2026, the court granted in part and denied in part the plaintiffs’ motion for a preliminary injunction. The court barred HHS from implementing the 2026 Policy, finding that the plaintiffs had demonstrated a likelihood of success on their claim that the 2026 Policy was arbitrary and capricious. However, the court declined to enjoin the termination of existing TPP grants, citing jurisdictional uncertainty under the Tucker Act.

This case is ongoing.
