This is a case challenging Executive Order 14203, Imposing Sanctions on the International Criminal Court.  On August 11, 2026, four human rights nonprofit organizations (American Friends Service Committee, Center for Constitutional Rights, Human Rights Watch, and Open Society Institute) filed a lawsuit in the U.S. District Court for the Southern District of New York alleging that the Trump administration created an unlawful “Sanctions Regime” through an Executive Order (EO) authorizing sanction…

This is a case challenging Executive Order 14203, Imposing Sanctions on the International Criminal Court. 

On August 11, 2026, four human rights nonprofit organizations (American Friends Service Committee, Center for Constitutional Rights, Human Rights Watch, and Open Society Institute) filed a lawsuit in the U.S. District Court for the Southern District of New York alleging that the Trump administration created an unlawful “Sanctions Regime” through an Executive Order (EO) authorizing sanctions against individuals and organizations affiliated with or assisting the International Criminal Court (ICC) in certain investigations and prosecutions opposed by the Trump administration. Plaintiffs alleged that this Sanctions Regime was unauthorized, unconstitutional, and unlawfully restrictive of their advocacy.

Plaintiffs claimed violations of the Administrative Procedure Act, Religious Freedom Restoration Act, First Amendment freedoms of speech and expressive association, Fifth Amendment due process rights, and claimed that EO 14203 was ultra vires under its governing statute, the International Emergency Economic Powers Act (IEEPA), 50 U.S.C. §§ 1701 et seq. Represented by private counsel, Plaintiffs sought a permanent injunction against EO 14203 and its associated Sanctions Regime, as well as declaratory relief and attorneys’ fees. The case was assigned to District Judge Jesse M. Furman and Magistrate Judge Ona T. Wang. 

In June and July of 2026, respectively, two similar complaints were filed: Prost v. Trump (26-CV-5305) and Democracy for the Arab World Now, Inc. v. Trump (26-CV-5957). On August 18, 2026, Judge Furman ordered that the parties in the instant case should confer and file a joint letter addressing next steps in light of the two related cases, including any potential impact that the ongoing preliminary injunction motion practice might have on the case. On August 26, 2026, the parties filed the joint letter as requested, requesting that the court adjudicate each of the pending preliminary injunction motions in the related cases, as well as the preliminary injunction motion Plaintiffs would file in this case, separately and on its own merits. The government did not oppose the proposed approach. Judge Furman agreed and ordered that unless and until the court ordered otherwise, the court would separately consider and decide each of the pending or forthcoming preliminary injunction motions.  

This case is ongoing.
