Case Summary

This case challenged federal sanctions that the plaintiffs alleged prevented them from submitting information to the International Criminal Court and collaborating with sanctioned human rights advocates. On July 15, 2026, Democracy for the Arab World Now, Inc. (DAWN), Taxpayer Alliance Against Genocide, and Taxpayer Alliance Against Genocide's president and treasurer filed this lawsuit in the U.S. District Court for the Southern District of New York. They sued President Donald J. Trump; the U.S. Departments of State, the Treasury, and Justice; the Office of Foreign Assets Control; and officials of those agencies in their official capacities. Represented by private counsel from J. Pace Law, PLLC, the plaintiffs sought declaratory and injunctive relief, attorneys' fees, and costs.

The plaintiffs asserted First Amendment speech and association claims, a Fifth Amendment due process claim, and claims under the International Emergency Economic Powers Act (IEEPA), 50 U.S.C. §§ 1701–1707, and the Administrative Procedure Act, 5 U.S.C. §§ 702, 706. On July 20, 2026, the court assigned the case to District Judge Jesse M. Furman and designated Magistrate Judge Ona T. Wang to handle referred matters.
The challenged sanctions arose from Executive Order 14203, issued on February 6, 2025, and its implementation. The order declared a national emergency concerning International Criminal Court (ICC) investigations or prosecutions of U.S. persons and certain allied-country persons, including Israeli nationals. It authorized sanctions against foreign persons involved in or supporting those efforts and prohibited providing or receiving funds, goods, or services to or from designated persons. The complaint described the designation of ICC prosecutors and judges, U.N. Special Rapporteur Francesca Albanese, and the Palestinian human rights organizations Al-Haq, Al Mezan, and the Palestinian Centre for Human Rights.

DAWN alleged that it had previously submitted evidence and legal analysis to the ICC concerning alleged crimes by Israeli and U.S. officials and had collaborated with Albanese and the Palestinian organizations on research, advocacy, and litigation-related work. DAWN alleged that the sanctions caused it to stop preparing ICC submissions, exchanging information, coordinating advocacy, and arranging certain events and training, and that it had abandoned plans to offer Albanese an unpaid fellowship. Taxpayer Alliance Against Genocide, an unincorporated association of U.S. taxpayers, alleged that it had withheld an ICC submission after months of research because its members feared civil and criminal penalties. The plaintiffs maintained that their requests to the Office of Foreign Assets Control for clarification had not produced substantive assurances that their proposed activities were lawful.
The complaint contained five claims. First, the plaintiffs alleged that the sanctions restricted protected speech, access to information, and association, discriminated against disfavored viewpoints, and were unconstitutionally overbroad. Second, they alleged that the undefined prohibition on providing or receiving a "service" failed to give fair notice of prohibited conduct and was unconstitutionally vague under the Fifth Amendment. Third, they argued that the restrictions exceeded presidential authority because IEEPA exempted certain personal communications and exchanges of information or informational materials, 50 U.S.C. §§ 1702(b)(1), (b)(3). Fourth, they alleged that the agencies' interpretation of the implementing regulations violated the Administrative Procedure Act because it conflicted with statutory and constitutional protections and exceeded statutory authority. That claim named the agencies and their officials, but not the President. Fifth, they argued that the sanctions exceeded IEEPA authority because the ICC's activities did not constitute the unusual and extraordinary threat required to support the declared emergency.

On July 20, 2026, Judge Furman ordered briefing on whether he should consolidate the case with Prost v. Trump, another challenge to the ICC sanctions, and invited the parties to address the proposal. On July 23, the plaintiffs moved for a preliminary injunction and filed a supporting memorandum and declarations. Their requested relief would prevent enforcement of the sanctions' speech and association restrictions while the case proceeded. After receiving the parties' submissions on consolidation, Judge Furman concluded on July 27 that consolidation with Prost would be inappropriate, leaving the cases separate.

A third related case, American Friends Service Committee v. Trump, was filed on August 11, 2026. In an August 26 order entered in that case, Judge Furman stated that he would consider and decide the pending or forthcoming preliminary-injunction motions separately unless he ordered otherwise. Meanwhile, the defendants filed an opposition memorandum on August 13 and the plaintiffs filed a reply memorandum on August 25.

The case remains ongoing.
