The United States filed a complaint on September 24, 2026, in the United States District Court for the District of Minnesota against the State of Minnesota, the City of Minneapolis, and the City of St. Paul (collectively, "the Cities"), alleging that the State’s permit-to-purchase and 30-day waiting-period regulatory scheme violates the Second Amendment for law-abiding Minnesota citizens without carry permits. The government contended that the law imposes an unjustified delay on handgun and regulated rifle purchases, including for home defense, while granting local law enforcement up to 30 days—without penalty—to approve permits. The complaint further alleged that Minneapolis and St. Paul law enforcement officers enforce these restrictions as part of a pattern or practice depriving individuals of their constitutional rights, with the scheme deemed presumptively unconstitutional under Bruen and Wolford due to its lack of historical analogs. The United States sought declaratory and injunctive relief, including a judgment that the Cities’ enforcement constitutes a violation of 34 U.S.C. § 12601(a) and the Second Amendment, as well as an order permanently barring the restrictions’ enforcement.
