Case Summary
(This summary is temporary as we research the case.)
On August 20, 2026, a federal employees’ union sued the Internal Revenue Service (IRS) in the U.S. District Court for the District of Columbia. The union challenged a July 2026 IRS directive that immediately denied all pending requests for advanced sick and annual leave and barred future requests, forcing employees in medical treatment onto unpaid leave. It alleged that the directive was arbitrary and capricious under the Administrative Procedure Act (APA), and that it was void because it was issued under the authority of an IRS “Chief Executive Officer" who was running the agency without Senate confirmation, in violation of the Appointments Clause.
