The Milwaukee office of the EEOC filed suit against Northcentral Technical College District Board of Trustees on December 30, 2004 in the U.S. District Court for the Western District of Wisconsin. The EEOC alleged that Northtechnical's Board of Trustees violated the Age Discrimination in Employment Act when they discriminated against one of their employees by filling a new administrative, teaching and marketing position with a younger individual based on his age. The defendant filed a motion for summary judgment in August 2005, which was granted on October 27, 2005. The court reasoned, that the plaintiff met the prima facie requirements for an ADEA case, as the new professor was considerably younger; however the Board of Trustees had a legitimate reason for hiring the younger professor when it determined that the younger professor was more qualified for the position. The court granted costs to Northtechnical.
The EEOC appealed, but the appeal was denied.
