Case Summary

On March 7, 1994, several African-Americans filed a class action under 42 U.S.C. § 2000(e) et seq, and 42 U.S.C. §§ 1981 and 1981A against defendant CSX Transportation, Inc. in the U.S. District Court for the Northern District of Alabama, Southern Division. The plaintiffs, represented by private counsel, asked the court for declaratory judgment, equitable relief and money damages, claiming that defendant had discriminated against the individually named plaintiffs and similarly situated African-American employees on the basis of their race. However, we don't know the plaintiffs' specific allegations because we cannot get the Complaint electronically.

On December 17, 1998, the Court (Judge U.W. Clemon) approved the Consent Decree, through which the parties settled the case. Per the Decree, defendant agreed to pay a settlement fund of $25,000,000.00. Also, defendant agreed to change some of its employment practices to avoid discrimination against African-Americans.
