On January 1, 2014, represented by private counsel and the Washington Lawyers' Committee Prisoners Rights Project, deaf and hard of hearing prisoners in the Kentucky prison system filed a lawsuit in the U.S. District Court for the Eastern District of Kentucky on behalf of themselves and those similarly situated against the Commonwealth of Kentucky, the Kentucky Justice and Public Safety Cabinet (JPSC), the Department of Corrections (KDOC), and eight individuals serving in leadership roles at JPSC or KDOC or as prison wardens. The complaint included numerous counts alleging violations of state and federal law and the U.S. Constitution. These were, as follows: disability discrimination in violation of the Americans with Disabilities Act, disability discrimination in violation of the Rehabilitation Act of 1973, free speech violations under the First and Fourteenth Amendments, violation of the Religious Land Use and Institutionalized Persons Act of 2000, violation of the free exercise of religion provided under the First and Fourteenth Amendments, violation of the freedom from cruel and unusual punishment provided under the Eighth and Fourteenth Amendments, violation of the portion of the Kentucky Civil Rights Act guaranteeing access to qualified interpreters, and violation of the portion of the Kentucky Civil Rights Act guaranteeing full and equal enjoyment of public accommodations irrespective of disability status. 

Specifically, the plaintiffs alleged in their complaint that the defendants discriminated against them in at least five different areas: 

  • ineffective access to telecommunications equipment such as Telecommunication Devices for the Deaf (TDD) and videophones that would allow them to communicate with their friends, family, and attorneys outside of the prison system;
  • ineffective access to sign language interpreters for access to medical services, administrative meetings, and prison programs, as well as to other auxiliary aids and services such as Computer Assisted Real Time or an assistive listening device or system;
  • ineffective access to prison alerts and announcements in a visual format;
  • ineffective access to interpreters and/or assistive listening devices or other auxiliary aids or services during disciplinary proceedings, thus denying the inmates the ability to understand the charges against them or the parameters of their punishment and the ability to adequately defend themselves; and 
  • ineffective access to employment and training opportunities in the various “prison industries.” 
    The plaintiffs asked the court for class certification, as well as injunctive relief, the recovery of actual damages, and monetary punitive and compensatory damages. They also demanded a jury trial on all counts.

The plaintiffs filed an amended complaint on October 1, 2014, wherein they named eleven additional individual defendants. On October 30, ten of the individual defendants moved for dismissal for failure to state a claim. These motions remained pending while the parties negotiated a settlement.

The parties reached a settlement in May 2015 as part of which they agreed to dismiss all claims with prejudice. The settlement agreement required KDOC to do the following:

  • ensure deaf inmates have full and equal access to and enjoyment of all services, privileges, facilities, advantages, and accommodations available to similarly situated non-deaf inmates;
  • assign a staff member at each KDOC adult institution as ADA coordinator to assist with implementing the settlement agreement and with providing, coordinating, and overseeing auxiliary aids and services for deaf inmates;
  • provide deaf inmates during initial intake with effective communication, a hearing assessment, and auxiliary aids and services;
  • ensure staff awareness of a deaf inmate's need for auxiliary aids and services through identification cards;
  • provide deaf inmates with the interpretation of materials it provides to all inmates;
  • provide deaf inmates with materials providing information about auxiliary aids and services available to them and instructions for how to obtain, request, or use them;
  • provide deaf inmates with a schedule showing when interpreters and other auxiliary aids and services are available;
  • provide deaf inmates with appropriate auxiliary aids and services, including qualified interpreters, as neeeed to ensure equal opportunity to participate in all services, privileges, and programs offered to other similarly situated inmates, including orientation; medical evaulations; on-site medical care and healthcare appointments; classification and transfer hearings; grievance, disciplinary, and parole hearings; and rehabilitative, educational, work, or transitional programs;
    permit volunteer organizations or individual volunteers providing religious or other activities to inmates to bring a qualified interpreter;
  • provide all medically necessary auxiliary aids and services to deaf inmates promptly upon request and free of charge, subject to a co-payment;
  • provide an in-person qualified interpreter for communications concerning medical care and attention; disciplinary hearings; transfer and classification processes; and transitional, rehabilitative, or educational programming;
  • provide deaf inmates opportunities for institutional work assignments consistent with opportunities for the same assignments given to similarly situated non-deaf inmates; 
  • provide effective non-auditory alert systems that will notify deaf inmates of both prison-wide events and events specific to deaf inmates and of an emergency evacuation or other emergency; 
  • provide deaf inmates with access to telecommunication devices enabling them to have outside communications that are substantially equivalent to the communications non-deaf inmates have using traditional devices such as telephones; 
  • ensure all audio-visual media and televisions purchased for inmates include open- or closed-captioning and that captioning will be turned on and remain on at request; and
  • adopt a revised hand restraint policy for deaf inmates.

The agreement also required KDOC to pay $250,000 in attorneys’ fees to the plaintiffs’ counsel and to pay each of the named defendants $1,500 in damages. 

The court issued a consent judgment on June 24, 2015, approving the settlement agreement, which had an effective date of on June 28, 2015. The agreement was scheduled to last for five years, after which KDOC attested it would continue to provide all accommodations required by law. The court appointed Professor Margo Schlanger as a settlement monitor to thoroughly and objectively assess KDOC's compliance with and implementation of the agreement. As monitor, Professor Schlanger was charged with issuing semi-annual reports to the court and the parties during the term of the agreement.

In February 2016, the monitor filed her first semi-annual report in which she assessed compliance with agreement items with deadlines in the first 90 days. The report stated that KDOC had made a “significant start towards compliance” but that much remained to be done. The report noted that each KDOC institution housing deaf inmates had an ADA Coordinator and a videophone available and that KDOC was partially compliant with the requirement to provide informational materials to deaf inmates about qualified interpreters and auxiliary aids and services. The report also noted that whether KODC was compliant with requirements to provide free access to videophones and to provide qualified interpreters for unscheduled medical emergencies and for disciplinary hearings was unclear. The monitor found that KDOC was compliant but difficult in meeting routine reporting requirements and partially noncompliant in meeting situational reporting requirements. Perhaps most importantly, the monitor’s report noted that KDOC “made no evident progress towards implementing” training requirements for its employees who interact with deaf inmates.

In December 2016, the monitor filed her second semi-annual report. This report noted that KDOC had continued to make progress toward compliance and that since the first report it had implemented staff training and worked toward prompt hearing aid evaluation and provision. That said, the monitor made recommendations for improving the training offered to KDOC employees. Importantly, the monitor also deemed that all requirements in the agreement without a specific implementation deadline to be effective. Moreover, having visited seven of the twelve KDOC adult institutions between the first and second report, the monitor also included in-depth discussion of and recommendations for improvements needed at a number of the institutions.

In May 2017, the monitor filed her third semi-annual report. The report noted that KDOC had continued to make progress toward resolving issues with hearing aids and had finalized computer-based training for staff. The monitor informed the court that after completing a full year of site visits she was finding “many fewer items” that needed additional recommendations for compliance and that she was thus shifting her approach to site visits going forward.

The fourth semi-annual status report, filed in November 2017, focused on hearing aids. The report concluded that the process for meeting inmate audiology concerns had improved but still needed further progress.

The fifth semi-annual status report, filed December 2018, covered an entire year, with various KDOC institutions having submitted self reports earlier in the year. This status report covered two sets of site-vists, a self-audit pilot program, and substantial work on audiology issues. The report identifeid five areas with ongoing compliance problems: the identification and tracking of deaf inmates, the provision of adequate telecommunications services that meet the needs of individual deaf inmates, inadequate remote interpretation and lack of in-person interpretation, inconsistency and delay in hearing aid provision, and effective communication (announcements, programming, etc.) equal access to services (e.g., religious, educational, and rehabilitative programming) for deaf inmates.

The sixth semi-annual status report, filed April 2019, noted that while progress was being made there was widespread continuation of two different kinds of problems. Specifically, the monitor found that: 

“[p]rocedurally, some institutions continued to struggle with keeping and sharing the records needed to comply with the agreement and to check on that compliance. And substantively, self-reporting and follow-ups reveal crucial areas of compliance weakness—areas that I have seen and described consistently in several prior reports, as many as three years ago. These include:

    • identification, tracking, and reporting of inmates who are deaf/hard-of-hearing;
    • ensuring prompt and accurate provision of audiology services;
    • providing interpretation, both in-person and remote; and
    • providing videophone services.”

The seventh semi-annual report, filed December 2019, noted that “very significant issues of non-compliance” remained and raised concerns that KDOC would not achieve substantial compliance with the agreement by the June 2020 expiry date. The monitor determined systemwide intervention/direction was needed for some widespread problems, including with respect to inmate tracking and transfer alerts, audiology standards and service delays, hearing aid loss, and availability and functionality of auxiliary aids.

The eighth semi-annual report, filed May 2020, found KDOC had “devoted real effort and attention” to addressing the issues raised in prior reports and accordingly made significant compliance progress. However, the monitor noted that while areas of non-compliance were shrinking, concerns remained about compliance at a couple of KDOC institutions generally and with respect to a couple of issues across institutions. On a positive note, the monitor indicated that she felt that the outstanding problems could be solved and the progress already made solidified in coming months if both headquarters and institution staff focused on the issues. That said, the monitor ultimately concluded that “given the challenges posed by the COVID-19 pandemic, full solution prior to the end of June 2020 seems unlikely.”

In response to the concerns raised in the monitor’s eighth report, the parties agreed in a joint filing dated August 3, 2020, to extend the term of the settlement through the end of 2020. On December 16, 2020, the monitor filed her 9th and final semi-annual report, which found significant improvement on KDOC's part. The monitorstated that while she “cannot say that each KDOC prison is complying with each and every settlement agreement provision… compliance with many of the ADA/Settlement Agreement requirements has been accomplished.” The monitor concluded her report by stating her belief that “KDOC has in place a system already compliant in large part with the ADA and the settlement agreement—and capable of maintaining its successes and improving going forward, if [KDOC] continues to appoint, train, and support the ADA Coordinators and their efforts.”

The settlement term expired at the end of 2020 and no further action has occurred in this case.

Atkins: (1) Parties' request for settlement conference is GRANTED, and a ( SETTLEMENT CONFERENCE set for Tuesday, 1/27/2015 at 9:00 AM at the KY State Reformatory ("KSR") in LaGrange, KY. (2) On or before WEDNESDAY, NOVEMBER 26, 2014, defense counsel must file a report with the Court detailing how the parties will be able to communicate during the settlement conference with Plaintiff Michael Knights, who is currently housed at the Kentucky State Penitentiary in Eddyville, Kentucky. Defense counsel's report should also detail the Department of Correction's requirements for access to the KSR facility (e.g., picture I.D., prohibited items) in order to facilitate an efficient entrance into the facility for all parties; (3) Defense counsel is ordered to ensure that Plaintiffs' counsel has access or a means to communicate with both named Plaintiffs, Oscar Adams and Michael Knights, throughout the day of MONDAY, JANUARY 26, 2015 so that Plaintiffs may adequately prepare for the settlement conference; (4) Counsel are directed to have their respective client and/or representative, fully authorized to negotiate and approve a settlement in this matter, present (physically or by electronic transmission) at this conference. The parties attention is directed to Lockhart v. Patel, 115 F.R.D. 44 (E.D. Ky. 1987). Telephone calls from the conference beyond those necessary for communication with Plaintiff Michael Knights may not be made for the purpose of obtaining authority for any offer or counteroffer to settle, or to approve a proposed settlement, and any party requesting or requiring such will be considered in violation of this Order; (5) By no later than TUESDAY, JANUARY 13, 2014, counsel shall submit to the undersigned separate, confidential statements which shall specify their respective settlement positions. Each statement is to be furnished only to Magistrate Judge Atkins and not to the other side. The statements shall not be filed with the Clerk of the Court or the presiding judge. Said statements shall be transmitted by email (atkins_chambers@kyed.uscourts.gov) and shall not exceed a total of ten (10) pages; (6) In their respective statements, counsel shall make a candid assessment of the strengths and weaknesses of both sides, an appraisal of issues such as liability, and the anticipated economic cost of further preparation and litigation of this matter through trial. (7) The Magistrate Judge requests that bona fide settlement negotiations commence as soon as practicable and be conducted as often as necessary prior to the settlement conference. Compliance with this requirement will be satisfied only when, prior to the conference, the parties communicate regarding an offer to settle, and counter- offer. (8) Finally, the Court acknowledges that the parties discussed the possibility of submitting a new agreed scheduling order in this matter and the Court denying without prejudice the parties' previously-submitted agreed order [R. 53]. However, the record reflects that the parties' previously submitted scheduling order has already been adopted by the Court [R. 57].
