On June 5, 2017, a Louisiana detainee filed this putative class-action lawsuit in the U.S. District Court for the Western District of Louisiana. On June 5, 2017, a Louisiana detainee filed this putative class-action lawsuit in the U.S. District Court for the Western District of Louisiana. He had been arrested and detained after being charged with felony theft and was unable to post the $375 bond to a for-profit bonding agent to clear his $3000 bail. The plaintiff sued the Sheriff, District Commissioner, and Chief Judge for the 15th Judicial District of Louisiana under 42 U.S.C. § 1983 and 28 U.S.C. § 2201. Represented by Civil Rights Corps, MacArthur Justice Center, and Loyola University School of Law, the plaintiff sought to represent a class of all arrestees who were or would be detained in that state district--which covered Acadia, Lafayette, and Vermillon Parishes--for any amount of time after an arrest because they were unable to pay money bail. He claimed that the district scheme of setting bail amounts without further inquiry into a person's ability to pay violated his Due Process and Equal Protection rights under the Fourteenth Amendment. He sought an injunction, declaratory relief, and attorney's fees and costs.

This case was referred to Magistrate Judge Patrick Hanna and Judge Robert G. James. Judge James recused himself and the case was reassigned to Judge Elizabeth E. Foote.

The defendants filed motions to dismiss for lack of subject matter jurisdiction and for failure to state a claim. They also argued that the claim was moot because the plaintiff was no longer in jail. On July 20, 2021, the case was stayed as the parties engaged in settlement talks under Judge Hanna's orders. After several months of unsuccessful settlement talks, the stay was lifted even though settlement discussions continued. The defendants claimed there was nothing to settle and the plaintiff claimed irreparable harm was ongoing.

On December 6, 2017, Judge Hanna issued a Report and Recommendation in response to the Commissioner's motion to dismiss. The report recommended that the motion should be granted with respect to plaintiff's equal protection claims and due process claims against the 15th Judicial District Chief Judge. The Judge also recommended that the motion be denied to the extent that it requested dismissal of due process claims against the Commissioner. 2017 WL 9772104.

On December 11, 2017, Judge Hanna issued a second Report and Recommendation in response to the Sheriff's motion to dismiss. The report recommended the motion be denied with respect to subject matter jurisdiction because the claim was not moot and Younger abstention did not apply. However, Judge Hanna recommended dismissal for failure to state a claim against the Sheriff. 2017 WL 8161160. The plaintiff objected to both of these reports and sought oral argument before Judge Foote. On January 12, 2018, Judge Foote granted a hearing.

On February 14, 2018, the plaintiff and an intervenor filed a motion to intervene or to consolidate the case with the intervenor's individual case, 6:18-cv-00159. Later that month, on February 26, the plaintiff filed a motion to amend the complaint, which was granted later by Judge Foote.

Judge Foote partially adopted the second Report and Recommendation on March 6, 2018. She denied the Sheriff’s motion to dismiss for lack of jurisdiction, but also declined to dismiss the complaint for failure to state a claim so that the plaintiff could file a supplemental complaint. 2018 WL 1188077. Two days later, on March 8, Judge Hanna partially adopted the first Report and Recommendation, denying the motion to dismiss as to all claims against the Commissioner and the Chief Judge. Judge Hanna held that the plaintiff sufficiently alleged that his Equal Protection rights were violated by the District not adjusting bail for income, and that his Due Process rights were violated by the District waiting a week or more before an individualized bail decision. 2018 WL 1221119. Judge Hanna also denied the plaintiff’s motion to certify a class without prejudice. 

The next day, on March 9, the plaintiff filed a supplemental complaint because since the lawsuit was filed, the Sheriff had revised the policies for how people in jail can gain eligibility for certain diversion programs that could lead to release. On March 27, the defendant filed a motion to dismiss the supplemental complaint and original complaint for failure to state a claim.

Discovery then followed. On April 12, 2018, Judge Foote granted the plaintiff’s motion to intervene and denied the motion to consolidate cases. Later that year, on June 28, the defendant filed a motion for sanctions regarding the plaintiff’s supplemental complaint.

On August 28, 2018, Judge Hanna issued a Report and Recommendation. She recommended that the Sheriff’s motion to dismiss filed on March 27 should be granted in part and denied in part, and that the re-urged first motion to dismiss the original complaint should be granted. 2018 WL 6036911. The next day, Judge Hanna filed an additional Report and Recommendation, recommending that the motion for sanctions be denied. 2018 WL 6028683.

On October 26, 2018, the plaintiff filed a motion for partial summary judgment against the Sheriff but later withdrew this motion. On the same day, the defendants also filed a motion for summary judgment to dismiss the plaintiff's claims. The plaintiff filed a motion for partial summary judgment again on October 30.

The following month, on November 9, this case was reassigned to Judge Terry A. Doughty. A few days later, on November 14, Judge Doughty adopted the Report and Recommendation of Judge Hanna, granting the motion to dismiss the supplemental complaint and original complaint for failure to state a claim. The plaintiff’s claims against the Sheriff were dismissed without prejudice. 2018 WL 5993879. Furthermore, Judge Doughty adopted the second Report and Recommendation and denied the motion for sanctions. 2018 WL 5987022.

On December 3, 2018, Judge Doughty denied both the plaintiff's and defendants’ motions for summary judgment. 2018 WL 6314730. The court held a bench trial on August 6, 2019.

Early the following year, on February 7, the court entered judgment in favor of the defendants. 2020 WL 605028. The court determined that after 2018, the district had stopped using a written schedule of predetermine bond amounts. The court therefore held that defendants’ new practices, including not using a bail schedule, rendered the plaintiff's initial claims moot. In addition, the court held the defendants provided adequate procedural protection to arrestees, including the automatic release of most misdemeanor arrestees, which is more than what the Constitution requires. Lastly, as to the plaintiff's equal protection claims regarding arrestees who cannot afford to pay a secured bond, the court held that the defendants’ orders, policies, and practices were “narrowly tailored” to address their compelling interest in assuring the “future appearance and lawful behavior” of the more serious misdemeanor and felony arrestees.

On March 5, 2020, the plaintiff appealed this judgment (and other previous orders) to the U.S. Court of Appeals for the Fifth Circuit (case number 20-30159). On April 3, 2020, the Fifth Circuit granted the plaintiff's unopposed motion to stay further proceedings while the parties waited to see what the result was in a related case, Daves v. Dallas County. The stay was lifted on February 11, 2021, but the case was stayed again a month later. Briefing resumed in January 2022, and oral argument was held later that year, on November 7.

The following year, on June 21, the Fifth Circuit vacated the judgement and remanded the case back to the district court to dismiss the case. 71 F.4th 340. While the appeal was pending, the Fifth Circuit had held in Daves v. Dallas County that federal courts shouldn't hear cases about the way local jurisdictions use bail if the constitutional issues can instead be raised in state court. 64 F.4th 616. This was justified under the doctrine of Younger abstention, which prevents federal courts from interfering with state court proceedings. The parties here agreed that these issues could be presented in state court. The plaintiff had to pay the defendants the costs of appeal. The district court subsequently dismissed the case without prejudice as a result of the Fifth Circuit’s order on July 19, 2023.

On September 25, 2023, the plaintiff filed a petition for a writ of certiorari to the United States Supreme Court (case no. 23-291), asking the Court to address the Younger abstention issue. After the parties submitted briefs, the Supreme Court denied the petition on February 20, 2024 without an explanation. The Supreme Court also denied the petition for a writ of certiorari in Daves v. Dallas County.

This case is now closed.
