MINUTE ORDER: During the oral argument on the pending motions to dismiss and for class certification on March 26, 2018, counsel for the defendant, in response to a question from the Court, stated, "I think both sides feel that settlement is a possibility; however, there is a pending funding request in front of the Colorado legislature that I think greatly impacts this case, and it's not known if that will be -- make it on to the final long bill at this time. We should know probably in May." ECF No. 62 (transcript) at 2. The Court requests an update by June 8, 2018, on the funding request and how, if at all, prospects for settlement have been affected by that or any other factors. The parties are familiar with the thinking of the AASLD/IDSA and the CDC, as well as decisions that have been issued by courts to date on motions to dismiss and/or for class certification in similar cases in other jurisdictions.
