Section XII(C)(1) states that "Each Class Member may be awarded the following amounts, which may be aggregated..." First, the word "may" appears to be ambiguous. Does it mean that the dollar amounts which follow are caps on what the Settlement Administrator may award, and that lower amounts can be awarded in his discretion? If so, have any criteria been provided for his exercise of discretion? If, on the other hand, the intent is to set fixed amounts that will be available to qualifying class members, should the word be "shall"? The language could be changed to read "Each Class Member who qualifies for a distribution under this Agreement shall be awarded the following amounts for which he or she qualifies...," or words to that effect. Second, what is meant by "which may be aggregated"? The parties shall file a joint response, as soon as reasonably possible, that addresses these issues.
