The plaintiffs alleged that city/county’s inaction allowed conditions to exist and grow, especially during the Covid-19 pandemic, in violation of their fundamental rights. Specifically, the plaintiffs asserted claims under the Americans with Disabilities Act, 42 U.S.C. §§ 12131 et seq. (the “ADA”); Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. §§ 794 et seq. (“Section 504”); and the Fifth and Fourteenth Amendments of the United States Constitution, through 42 U.S.C. § 1983, and California state law. The lawsuit listed 14 claims for relief concerning improving health and safety, access to property and businesses (including compensation for “takings”), addressing homelessness issues, ensuring and maintaining accessible sidewalks and rights-of-way, access to benefits and services, remedying public nuisances, support and protect the provision of medical care to the indigent, and protecting life, liberty, property, and other rights. The case was assigned to District Judge Jon S. Tigar.  

Soon after the case was filed, several non-profit organizations that provided services to homeless people in the Tenderloin filed a motion to intervene in the case with the goal of ensuring that any remedy issued by the court treated homeless people with disabilities fairly. TO do so, they brought claims against the City under the ADA and Section 504. The intervenors were represented by attorneys from the Public Interest Law Project, Disability Rights California, and Bay Area Legal Aid. Judge Tigar granted their motion on June 30, 2020.

After several settlement conferences facilitated by Magistrate Judge Jaqueline Scott Corley, the parties reached a settlement and on October 7, 2020 Judge Tigar dismissed the case, but retained jurisdiction over the settlement terms. The settlement involved an agreement to reduce the number of homeless camps, finding alternative living arrangements for individuals, creating “safe sleeping villages,” and designating areas for tents for 50-70 tents, until three months after the Covid-19 state of emergency is ended by the mayor. There has been no action on the docket since then.
