This case involves the denial of equal access to the Section 8 Housing Choice Voucher Program (“Voucher Program”) by the Greater Dayton Premier Management (“GDPM”) and Dayton Metropolitan Housing Authority (“DMHA”). The plaintiff, a blind individual, represented by Disability Rights Ohio and Advocates for Basic Legal Equality, Inc., filed suit in the U.S. District Court for the Southern District of Ohio on August 22, 2013. The plaintiff sued GDPM and DMHA for alleged violations of the Fair Housing Amendments Act, Section 504 of the Rehabilitation Act of 1973, and Title II of the Americans with Disabilities Act. She alleged GDPM and DMHA discriminated against her based on her disability by failing to provide her requested accommodation of all correspondence be provided on microcassette tapes, thus jeopardizing her voucher by making abiding by the Voucher Program paperwork requirements more difficult. Judge Walter H. Rice presided.

Prior to litigation, in 2003, DMHA agreed to provide plaintiff all correspondence on microcassette tape, since she cannot read written correspondence due to her disability, but compliance with the agreement was spotty. In 2012, GDPM assumed authority for administering the Voucher Program and took the position that taping all communications was an undue administrative and financial burden, and not required by law. Subsequently, plaintiff filed her lawsuit and motion for preliminary injunction requesting GDPM be ordered to send all correspondence on microcassette tapes. Judge Walter H. Rice presided over this matter. After discovery was complete, an evidentiary hearing was held on January 16 and 23, 2024 and plaintiff’s request for preliminary injunction was granted on March 28, 2014.  The parties mediated and the matter settled on October 14, 2014. As part of the settlement, GPDM agreed to pay plaintiff $26,000.00 in damages, provide a single point of contact at GPDM, provide written communications via email a laptop with screen reader allowing her to access written communications via email, undergo training on reasonable accommodations, and adopt a new reasonable accommodation and effective communication policy. GPDM also agreed to pay $106,500 in attorney’s fees.
