(This summary is temporary, while we research the case.) Plaintiffs West Alabama Women’s Center and Dr. William J. Parker brought an as-applied challenge to state abortion regulations. An Alabama Administrative Code regulation required that abortion providers in the State maintain staff admitting privileges at a local hospital.
 
Initially, the plaintiffs moved for a temporary restraining order, on the grounds that the regulation imposed an unconstitutional burden on women seeking abortions, because compliance with the regulation would not be possible and the clinic would therefore have to close. The court granted this motion, and the parties then entered into a joint stipulation, which waived enforcement of the regulation to West Alabama Women’s Center until August 24, 2016. As part of the joint stipulation, the proceedings were stayed for one year, the Center would remain open, and in the interim the Alabama Department of Public Health would work to modify the challenged regulation such that it no longer was unduly burdensome. The Department also granted a temporary waiver to the clinic. The Department of Public Health removed the requirement that admitting privileges be required.
 
As part of their challenge, West Alabama and Parker added a challenge to two recently enacted statutes that impacted abortion access in Alabama, a school-proximity law, which restricted licenses to abortion clinics located within the radius of a school, and a fetal-demise law, which criminalized the most common method of second-trimester abortion. The plaintiffs claim that the laws and regulations are unconstitutional restrictions on abortion access in Alabama that violate the Due Process Clause.
 
The court held that Alabama’s school-proximity law was unconstitutional, and the state was enjoined from enforcing it. The court also held that the fetal-demise law was also unconstitutional, although the private civil-enforcement provision was not unconstitutional.
