This is a putative class action suit brought by and on behalf of children with disabilities who alleged that they did not get their educational needs met by their schools due to online learning during the COVID-19 pandemic. On June 30, 2021, the plaintiffs—children with disabilities and their parents—filed this lawsuit in the U.S. District Court for the Eastern District of Michigan. The plaintiffs sued the Michigan Department of Education (MDE), Ann Arbor Public Schools (AAPS), and Washtenaw Intermediate School District (WISD) under the Individuals with Disabilities Education Act (“IDEA”), Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act (“ADA”), the Equal Protection Clause of the Fourteenth Amendment, the Racketeer Influenced and Corrupt Organizations (“RICO”) Act of 1970, and state law and regulations. 

On March 16, 2021, AAPS closed its schools and ceased all in-person instruction due to the COVID-19 pandemic. According to the complaint, by closing its schools and ceasing in-person instruction, AAPS impermissibly altered without notice or input from the plaintiffs’ parents the plaintiffs’ individualized education plans (IEPs), which all named in-person instruction as the primary mode of education. Further, the plaintiffs alleged that by failing to call IEP meetings after virtual instruction began, the defendants failed to provide free appropriate public education (FAPE) to the plaintiffs.

Represented by Brain Injury Rights Group, the plaintiffs sought declaratory relief; a court order requiring local education agencies to follow procedural safeguards guaranteed by federal and state law and assigning special monitors for oversight and auditing; and attorneys’ fees and costs. The case was assigned to Judge Judith E. Levy.

On July 29, 2021, defendants MDE and the State Superintendent for MDE moved to dismiss the complaint. Defendant AAPS, along with its Executive Director of Student Intervention and Support Service and its Superintendent, and defendant WISD and its Superintendent, followed suit on August 19, 2021, filing separate motions to dismiss. 

On September 2, 2021, the plaintiffs moved for a preliminary injunction. The court ordered that motion held in abeyance on September 3, 2021, pending resolution of the motions to dismiss. 

On January 5, 2022, the plaintiffs moved for a temporary restraining order. After a hearing, on February 3, 2022, the court denied the motion for a temporary restraining order, holding that the relief sought in the motion was identical to the relief sought in the complaint. In another order on February 3, 2022, the court, citing representations of plaintiffs’ counsel at oral argument that certain claims could no longer be maintained and that others had been resolved, ordered the plaintiffs to clarify which counts of the complaint they wished to dismiss and which remained. On February 17, 2022, the plaintiffs clarified that they intended to pursue their IDEA, ADA, and RICO claims, and to maintain certain state law claims against the non-state defendants.  The court ordered supplemental briefing on the remaining claims on February 22, 2022. 

In the supplemental brief, filed on March 14, 2022, the plaintiffs addressed the justiciability of the remaining claims under Article III and how the plaintiffs intended to make their RICO claim. The plaintiffs argued that the claims were justiciable because they presented a live controversy: as long as COVID-19 remained a threat, the plaintiffs’ education was still subject to unilateral changes. The harm the plaintiffs sought to prevent could only be remedied through an Article III court; the administrative process did not provide injunctive relief to keep schools open. The plaintiffs asserted that they had a valid RICO claim because they had suffered a direct injury through financial harm in the loss of IDEA funds and harm to property in the denial of a FAPE, because the defendants had not used IDEA funds for the statutorily-mandated purposes. 

On July 22, 2022, the district court dismissed the case for lack of subject matter jurisdiction because the plaintiffs lacked standing to pursue injunctive or declaratory relief on all of their remaining claims. Specifically, the plaintiffs alleged only past harm, rather than continuing harm, as to their IDEA, ADA, and Michigan state law claims. The court dismissed their RICO claim because the plaintiffs had failed to establish causation and redressability: they failed to show that individual defendants had any involvement in the spending of IDEA funds or in the deprivation of the plaintiffs’ rights under IDEA, and they failed to show how the appointment of a RICO special monitor would redress the plaintiffs’ specific injuries. 616 F. Supp. 3d 711.

On August 17, 2022, the plaintiffs appealed the decision to the U.S. Court of Appeals for the Sixth Circuit. The following year, on May 10, the Sixth Circuit affirmed the district court’s decision. Specifically, the Sixth Circuit affirmed the district court's dismissal of the IDEA, ADA, and state law claims for lack of standing, holding that the plaintiffs failed to show continuing harm or sufficient risk of future harm, which would be required for declaratory or injunctive relief. The Sixth Circuit also held that any claims for compensatory relief were moot because the plaintiffs had already received it from administrative settlement agreements. The court also dismissed the RICO charge for failure to demonstrate sufficient causation between the defendants’ actions and the alleged harm, and for failure to demonstrate that the relief the plaintiffs sought would redress their alleged injury. The Sixth Circuit also held that the plaintiffs' claims were moot because the schools had gone back to in-person instruction, and the court found it unlikely that the schools would close again. 2023 WL 3347497.
