This is a case about a meat processing plant that refused to implement basic COVID-19 precautions such as physical distancing, face masks, sick leave, and onsite testing, despite it being a uniquely susceptible environment for COVID-19. On November 23, 2020, three former employees at Noah’s Ark meat processing plant and a doctor filed this lawsuit in the U.S. District Court for the District of Alaska. The plaintiffs sued Noah’s Ark Processors under the Declaratory Judgment Act, 28 U.S.C. § 2201…

This is a case about a meat processing plant that refused to implement basic COVID-19 precautions such as physical distancing, face masks, sick leave, and onsite testing, despite it being a uniquely susceptible environment for COVID-19. On November 23, 2020, three former employees at Noah’s Ark meat processing plant and a doctor filed this lawsuit in the U.S. District Court for the District of Alaska. The plaintiffs sued Noah’s Ark Processors under the Declaratory Judgment Act, 28 U.S.C. § 2201. Represented by ACLU of Nebraska, ACLU national, and a private firm, the plaintiffs sought: a declaration that the defendant had caused a public nuisance, violated its common-law duty to provide a reasonably safe workplace, and violated the Families First Coronavirus Response Act; an injunction requiring the plant to follow COVID-19 precautions; and attorney’s fees and costs. The case was assigned to Judge John M. Gerrard and Magistrate Judge Cheryl R. Zwart.

On December 3, 2020, the plaintiffs filed a motion for preliminary injunction. Defendants opposed it, and also filed a motion to dismiss.  On March 1, 2021, Judge Gerrard granted the defendant’s motion to dismiss the case due to lack of standing, since none of the plaintiffs any longer worked at Noahs’ Ark Processors. 2021 WL 781287.  

This case is now closed.
