This is a racial profiling and illegal seizure case about an immigration raid at an East Tennessee meat processing plant conducted by officers from the Department of Homeland Security (“DHS”). In April 2018, DHS officers were assisting with an Internal Revenue Service (“IRS”) search related to alleged climes of the plant’s owner, but during the search, the DHS  officers seized and arrested approximately 100 Latinx workers without regard to their immigration status, while berating them with racial slurs and shoving firearms in their faces. None of the plant’s white workers were detained, and in the end, only eleven of the approximately 100 Latinx workers arrested were charged with any crime, none of which were violent.

On February 21, 2019, seven of the workers detained at the immigration raid filed a complaint in the U.S. District Court for the Eastern District of Tennessee, represented by the National Immigration Law Center and the Southern Poverty Law Center. The workers sought to certify their case as a class action lawsuit, and they sought monetary compensation for their suffering at the hands of the DHS officers. Since initially bringing the suit, the workers have amended their complaint several times, and now claim thirteen causes of action, including several violations of their fourth and fifth amendment rights (brought pursuant to Bivens), conspiracy to violate civil rights (42 U.S.C. § 1985), failure to prevent the violation of civil rights (42 U.S.C. § 1986), and a number of federal torts claims, including false imprisonment and false arrest, battery, assault, intentional infliction of emotional distress, and negligent infliction of emotional distress. 

The initial complaint identified nine DHS defendants, but since then, the workers have identified additional individual defendants revealed during early phases of discovery. Named defendants now include 51 individual DHS officers – including officers from U.S. Immigration and Customs Enforcement, Homeland Security Investigations, and U.S. Customs and Border Protection – as well as 42 IRS agents, and the United States of America.

Discovery Issues

Every step of Zelaya v. Miles has been characterized by contentious discovery. Immediately following the April 2018 raid, the workers’ counsel sent FOIA requests to DHS and ICE seeking information about the raid and its planning, which were denied and then ignored. As a result, the workers’ initial complaint, filed in February 2019, could only name nine individual defendants, as the DHS would not disclose other officers involved in the raid. After the court permitted the workers to seek expedited discovery, the government produced the names of individual DHS officers, and disclosed that there were many IRS agents present during the raid, but failed to disclose their names. In May 2019, the workers’ counsel sent FOIA requests to the IRS, and when the IRS denied their request, the workers sued the IRS to enforce compliance. The IRS still has not responded to the FOIA request. In December 2019, workers’ counsel served a Touly subpoena on the IRS, and the IRS disclosed the list of IRS agents involved for the first time in February 2020.

Similarly, individual government officers have continued to object to workers’ discovery requests. Most notably, on June 27, 2022, Magistrate Judge Steger recommended that the jury be given an adverse-inference instruction relating to Defendant John Witsell for his failure to appear in court and participate in discovery. Workers allege an operative claim against Witsell for his use of excessive force in violation of the Fourth Amendment.  

Issues with Judges

Two different district judges and three magistrate judges have presided over this case throughout its lifespan. At the start of the case, District Judge Pamela L. Reeves presided over the case, and Magistrate Judge H. Bruce Guyton presided over discovery. On August 28, 2020, the district court reassigned the case to District Judge Travis R. McDonough, and in February of 2021, he reassigned discovery on this case to Magistrate Judge Susan K. Lee. On September 24, 2021, Magistrate Judge Lee recused herself from the case on the basis that her impartiality might be questioned, though she declined to provide a more specific reason in her order of recusal. Judge McDonough then assigned Magistrate Judge Christopher H. Steger to manage discovery, and these two judges continue to preside over the case.

First Round of Motions to Dismiss

On October 4, 2019, the DHS moved to dismiss the workers’ complaint for failure to state a claim. Following briefing and oral argument, the court granted in part and denied in part the motions to dismiss on January 31, 2021. 516 F.Supp.3d 778. The court dismissed four of the five claims pertaining to the violation of the workers’ Fourth and Fifth Amendment rights, on the grounds that the asserted facts do not rise to the level of a Bivens claim for relief. The court denied the dismissal of all other claims. On May 5, 2021, the workers filed their Fourth Amended Complaint, providing additional factual support of their claims and adding 41 named IRS defendants. Although the court dismissed four of the officers’ Fourth and Fifth Amendment claims, the dismissed claims are still listed in the amended complaint, as the workers preserve their right to appeal the dismissals later.

Second Round of Motions to Dismiss

After the workers filed their Fourth Amended Complaint, the newly added IRS defendants moved to dismiss the claims against them on the grounds that the workers failed to bring the claims until over a year after the raid, meaning the one-year statute of limitations had passed. On January 26, 2022, the court denied these motions to dismiss. 2022 WL 16757083. The court reasoned that because the workers were not permitted to discover the individual IRS agents involved – following extensive objections and stalling by the IRS – the statute of limitations was tolled until February 10, 2021. Therefore, the workers filed their amended complaint well within the one-year statute of limitations, and their claims against the IRS agents were not dismissed. 

Class Action Certification

On May 31, 2022, the workers filed a motion for class certification of their remaining putative class claims: conspiracy to violate civil rights (42 U.S.C. § 1985) and failure to prevent the violation of civil rights (42 U.S.C. § 1986). The court found that the workers satisfied all requirements of class certification, and issued an order certifying these class claims on August 9, 2022. 342 F.R.D. 426.

Settlement

On August 29, 2022, the parties notified the court of their agreement on principle to settle the case. Under the settlement agreement, defendants agreed to pay a total amount of $550,000 to settle the class claims. Defendants further agreed to pay a total amount of $475,000 to six named plaintiffs to resolve their individual federal tort claims. The United States further agreed to allow more time for these six plaintiffs to adjudicate or apply for status adjustment and work permits. Finally, under the terms of settlement, defendants agreed to pay $150,000 in attorneys’ fees. Thus, defendants agreed to pay a total of $1,175,000 in monetary damages and attorneys’ fees.

The parties filed a joint motion for final approval of settlement on February 13, 2023, and the court approved the terms of settlement on March 2, 2023, dismissing the case pursuant to the settlement on the same day. The U.S. District Court for the Eastern District of Tennessee retains jurisdiction over all matters related to the interpretation, administration, implementation, and enforcement of the settlement agreement.
