This is a case about prison officials' deliberate indifference toward the medical needs of incarcerated persons who suffered from hepatitis C. On September 20, 2005, four individuals who were or had been incarcerated at the Illinois Lincoln Correctional Center ("Lincoln") filed this putative class action lawsuit in the United States District Court for the Central District of Illinois. Judge Harold A. Baker was assigned to the case.

Represented by private counsel, the plaintiffs sued Lincoln's warden, its medical director, and the director of the Illinois Department of Corrections (IDOC) under 18 U.S.C. § 1983 for violations of the Eighth and Fourteenth Amendments of the U.S. Constitution. They alleged that the defendants had refused to provide medical treatment after the plaintiffs were diagnosed with hepatitis C. The plaintiffs claimed that they requested treatment and then fully complied with IDOC's grievance process when their treatment was refused. The plaintiffs sought a declaratory judgment regarding the unconstitutionality of the defendants' deliberate indifference. They sought injunctive relief ordering the defendants to comply with federal guidelines regarding treatment of hepatitis C. They also sought compensatory and punitive damages and attorneys' fees. 

After the filing of the complaint and reply, the parties proceeded to discovery. At the close of the discovery period, on April 21, 2006, the defendants moved for the court to sanction the plaintiffs as a consequence of one plaintiff's failure to attend a scheduled deposition. On June 6, 2006, the court granted the motion. It ultimately awarded the defendants their costs associated with that absence: $17.50.

During that same spring, on May 31, 2006, the plaintiffs moved to certify a class defined as: "those inmates within the Department of Corrections who at some point in time during their incarceration had Hepatitis C and elevated liver enzyme levels but received no treatment for that Hepatitis." A few months later, on August 21, the defendants moved for summary judgment.

On March 28, 2007, the court decided both of the outstanding motions. The court denied class certification and granted the motion for summary judgment in part and denied it in part. The court granted summary judgment in favor of two of the three defendants, leaving Lincoln's medical director as the only defendant. The court dismissed the injunctive claims of three of the plaintiffs, reasoning that because they had been released from prison, they were ineligible for injunctive relief. The court also dismissed one plaintiff's pre-incarceration claims as barred by Illinois' statute of limitations. 2007 WL 951920.

After a trial held on February 14-15, 2008, a jury reached verdicts in favor of all four of the plaintiffs and against Lincoln's medical director. The jury awarded each plaintiff $20,000 in compensatory damages and $2,000,000 in punitive damages. The court directed the plaintiffs to file written requests for whatever injunctive relief would be appropriate. The defendant filed a motion on March 4, 2008, for judgment as a matter of law or, in the alternative, for a new trial.

As requested by the court after trial, on March 6, 2008, the plaintiffs filed a motion for a permanent injunction. They asked the court to order IDOC to comply with the current treatment protocol for hepatitis C published by the National Digestive Disease Information Clearinghouse. They requested continuing treatment through public assistance for incarcerated persons who would be released during the course of their treatment. They also asked the court to order IDOC to sue entities who had been unjustly enriched by IDOC's policy of denying treatment. Finally, the plaintiffs asked the court to appoint a physician who would act as an advocate for incarcerated hepatitis C patients. 

While their motion for a permanent injunction was pending, the plaintiffs filed two additional motions: a request for reconsideration of class certification and a request that one of the still-incarcerated plaintiffs be released for medical treatment. Less than a month later, that plaintiff passed away from cirrhosis, the end-stage result of hepatitis C. 

The court denied the plaintiffs' motion to reconsider class certification on June 26, 2008. The plaintiffs' proposed injunctive relief was also denied because, by this point in time, the only plaintiff who remained alive but still in custody had received his requested treatment. The court set a deadline for the incarcerated plaintiff to request injunctive relief, if any was appropriate. Over the next several months, that plaintiff filed two pro se motions for injunctive relief. The court denied the pro se motions on October 22, 2008, noting that counsel needed to file motions on his behalf. Plaintiff's counsel did so on October 24, 2008, requesting a court order that IDOC provide the plaintiff with re-testing for hepatitis C and any additional treatment recommended by the federal guidelines. The plaintiff also asserted that he had been transferred to a different facility in retaliation for his participation in litigation, and he requested a court order to for his transfer back to Lincoln.

On February 18, 2009, the district court ruled on the defendant's motion for judgment as a matter of law. 2009 WL 10681182. The court granted judgment in the defendant medical director's favor, vacating the jury's verdicts and damages awards regarding three of the four plaintiffs. The court sustained the verdict and compensatory damages award regarding the plaintiff that passed away from cirrhosis, but it reduced the jury's punitive damages award from $2,000,000 to $20,000. Over the next few weeks, the defendant moved for and was awarded $1,065.60 in costs.

As part of the February 18 order, the incarcerated plaintiff's requested injunctive relief was denied as moot because he had been re-tested and found to be hepatitis-free. His transfer request was denied for being outside the scope of this litigation. 

The plaintiffs immediately appealed the district court's judgment in favor of the defendant to the U.S. Court of Appeals for the Seventh Circuit. While that appeal was pending, on March 24, 2009, the district court issued a second amended judgment that substantively reiterated its February 18 order, finalized its remittitur of the damages awarded to the estate of the plaintiff that passed away from cirrhosis, and closed the case. The defendant filed a cross-appeal to the Seventh Circuit one month later.   

On January 28, 2011, Judge Kenneth F. Ripple issued an opinion affirming the district court's decisions. 631 F.3d 843. 

The case is now closed.

TEXT ORDER: The plaintiffs' request to strike the defendants' motion for summary judgment as untimely is denied. The plaintiffs do not object to an extension to file dispositive motions; their response asks that, if the extension is granted, that their discovery deadline and expert disclosure deadline be extended as well. The defendants had good cause for filing their motion for summary judgment past the deadline (the need for Dr. Elyea's deposition transcript). The defendants' motion for summary judgment will therefore be considered on its merits. The defendants' motion for an extension is denied as moot (d/e 19). The plaintiffs shall have until October 31, 2006, to file their response to the summary judgment motion. The plaintiffs may attempt to oppose the summary judgment motion with experts of their own, subject to meritorious objections by the defendants, who may file a reply or other appropriate motion within 30 days of the plaintiffs' response. However, the plaintiffs must also make the disclosures required under Rule 26(a)(2) by October 31, 2006, if they seek to rely on experts. The court is not extending the deadlines for expert disclosure at this time. The court is only allowing the plaintiffs to present the experts they wish to be considered. Whether those experts will be considered will be determined after all parties have had a chance to state their positions. The discovery deadline remains unchanged. If the plaintiffs seek a reopening of discovery in order to oppose summary judgment, they must file a motion stating the specific information they seek, explain why the information is necessary to their case, explain why they were unable to obtain the information during discovery, and state how much time they need. As many of the issues in the summary judgment motion are also relevant to the motion to certify class, both motions will be ruled on together. The defendants' motion seeking $17.50 for costs incurred for the no-show deposition of Stasiak is granted (d/e 16). The plaintiffs' motion to make per diem argument is denied as premature (d/e 12).
