On June 4, 2021, six Hmong residents of Siskiyou County, California, represented by private counsel, filed this lawsuit in the United States District Court for the Eastern District of California. The case was assigned to Chief District Judge Kimberly J. Mueller and Magistrate Judge Dennis M. Cota. The plaintiffs sued Siskiyou County, its sheriff, its county counsel, and its board members under 42 USC §1983 for violations of the Fourth Amendment's seizure clause and Fourteenth Amendment's equal protection and due process clauses. The plaintiffs alleged that the county passed various water conservation ordinances that discriminatorily targeted Hmong neighborhoods to deprive them of water, and that the county denied Hmong residents' property right to water access. The plaintiffs sought declaratory and injunctive relief, compensatory and punitive damages, and attorneys' fees. They also moved for a preliminary injunction that same day to restrict the ordinances from being enforced. 

The plaintiffs filed an amended complaint on July 15, 2021, adding the California Department of Forestry and Fire Protection as a defendant. 

On September 3, 2021, the court granted in part the plaintiffs' motion for preliminary injunction to prevent the ordinances from being enforced. The court held that the plaintiffs failed to demonstrate that they were likely to succeed on the merits for their claims that the water ordinances were overbroad and deprived them of their due process property rights, or that the ordinance banning the use of groundwater for illegal cannabis farming violated equal protection. However, the court held that the plaintiffs were likely to succeed on the merits for their claims that the water extraction and water truck permit requirements violated equal protection and may have been enacted with discriminatory intent. The court recognized that the permit application process placed a disproportionate burden on the Hmong community and there were serious questions about how the permits would accomplish the county's goals of reducing crime, environmental harm, water waste, and dangerous living conditions. Without access to water, residents would face dehydration and be forced to leave their homes without compensation. The court granted the preliminary injunction in light of the risk for irreparable harm to the plaintiff, and acknowledging that water deprivation placed heavy hardships on the plaintiffs that weighed the balance of equities and public interest in favor of allowing temporary relief. 558 F.Supp.3d 850.

The defendants moved to dissolve the preliminary injunction on February 18, 2022 because three changes had occurred since the preliminary injunction was entered: (1) the ordinances applied to all of Siskiyou County, instead of only being enforced in Hmong neighborhoods, (2) trucks carrying potable water were exempted from the complying with the permit requirements, and (3) the county simplified the permit applications process. The court denied the defendants' motion on May 15, 2022. Although the court recognized that there had been significant changes for the purpose of dissolution and that the county had responded to the initial criticisms about its policies, those changes did not call for dissolution when viewed under the preliminary injunction's initial governing legal standard. The changes to the permit applications were not amendments to the ordinances themselves, and the county had not shown that the plaintiffs were likely to obtain enough water for their basic needs if the preliminary injunction were lifted. Thus, the court held that the preliminary injunction would remain because Siskiyou County had failed to establish why it was no longer warranted

This case and Chang v. County of Siskiyou were reassigned to Chief District Judge Kimberly J. Mueller and Magistrate Judge Allison Claire on September 16, 2022. Judge Mueller determined the two cases were related because they involved similar questions of fact and law, so reassignment would promote judicial savings and convenience for all parties.

As of October 2022, this case is ongoing.
