This case concerns the Americans with Disabilities Act and age discrimination.  On December 8th, 2016, the named plaintiff, a young man with a disability requiring regular medical aid, filed this lawsuit in the U.S. District Court for the Northern District of Illinois, individually and on behalf of a class of similarly situated individuals.  The plaintiff sued the Director of the Illinois Department of Healthcare and Family Services (“HFS”).  Represented by private counsel, the plaintiff sought an injunction against the reduction of existing medical funding and declaratory relief. The plaintiff argued that decreasing the in-home shift nursing funding of persons aging out of a Medicaid program known as Nursing and Personal Care Services (“NPCS”) at 21 years of age purely based on their chronological age and rather than their medical needs violated both the Americans with Disabilities Act, 42 U.S.C. §12132 (ADA) and §504 of the Rehabilitation Act, 42 U.S.C. 794(a). At the time of the suit, Illinois ran a number of programs through Medicaid providing medical care funding for youths with disabilities.  As these youths aged out of programs their coverage changed, but their needs stayed the same, forcing families to make difficult, potentially life threatening decisions. . In the decade prior to this case there were five individual cases, and a class action suit in Illinois dealing with similar circumstances in which the plaintiffs prevailed.  

The case was assigned to District Judge Robert M. Dow Jr. and a class certification was immediately sought by the Plaintiffs under two theories.  First, the plaintiffs argued that they were at risk of significant harm or suffering because the state restricted NPCS enrollment to those under 21, forcing them to age out into a different program, Home Services Program (“HSP”), a program with lower funding caps. Second, the plaintiffs argued that those enrolled in NPCS were being discriminated against because similarly situated individuals aging out of a different state program–the Medically Fragile, Technology Dependent Children(“MFTD”) program–continued to receive the care they required.  

Throughout the lawsuit some class members were afforded injunctive relief so that their medical needs would be provided for while the case was adjudicated. The defendants agreed to provide relief for all putative class members that would age out of the program on, or before May 15, 2017. Further information regarding injunctive relief during the course of adjudication is unavailable.   

On December 21st, 2017, the court denied in part and granted in part the motion for class certification, finding the plaintiffs did qualify for class certification under their second theory based on an argument in Amundson ex rel. Amundson v. Wisconsin Department of Health Services, which suggested that persons with disabilities can establish claims of discrimination by showing worse treatment than other individuals with disabilities. 721 F.3d 871, 874 (7th Cir. 2013).   

On April 17th, 2019, the parties had a hearing before Judge Dow Jr., and presented a settlement. The parties settlement outlined that class members would upon request, or with permission, be evaluated for the MFTD waiver program.  Per the agreement, HFS is not obligated to provide care under any specific plan, or to necessarily provide care that they would not have otherwise provided. Additionally, defendants paid $140,000 in attorney’s fees.  Approval for the settlement was granted and the case was terminated without prejudice for a period of three years so that it could continue to be monitored. As of April 17, 2022 the Clearinghouse believes the case was closed and  dismissed with prejudice .
