On July 2, 2001, plaintiff filed this action pro se in the U.S. District Court for the District of South Dakota.  The case was assigned to Judge Lawrence L. Piersol. On July 2, 2001, plaintiff filed this action pro se in the U.S. District Court for the District of South Dakota.  The case was assigned to Judge Lawrence L. Piersol. Plaintiff had been diagnosed with Hepatitis C virus (HCV) while in the custody of the South Dakota Department of Corrections in 1998, and, in the intervening years, was evaluated on numerous occasions by Department medical staff but never provided interferon-based treatment.  In his complaint and in an amended complaint filed on September 18, 2002, after appointment of counsel, he alleged that the failure to treat his HCV was the denial of necessary medical care in violation of his Eighth Amendment rights.  He also brought Eighth Amendment-based claims related to the failure to timely inform him of his positive HCV and Hepatitis B test results and alleged treatment with incorrect medication.  He sued various officials and employees of the Department of Corrections.  He sought injunctive relief requiring the Department to develop policies for hepatitis testing and to treat his hepatitis; punitive and compensatory damages; and costs and fees. 

Defendants filed a motion for summary judgment on February 28, 2003; plaintiff did not dispute that the motion should be granted as to all defendants except the physician primarily responsible for his treatment while in custody, and as to all claims except denial of medical treatment in violation of the Eighth Amendment. On September 29, 2003, the district court denied summary judgment as to those remaining claims.  The court reasoned that plaintiff had a serious medical need for interferon treatment and that he had been deprived of that need.  It noted that the defendant had not put into the record a reason why plaintiff was not a candidate for interferon treatment, but had never formally requested such treatment for plaintiff despite knowing the risks of untreated HCV.  Because the only apparent reason for denying interferon treatment was the cost, and not any medical reason, the defendant was not entitled to qualified immunity.     

Defendant appealed. On October 1, 2004, the U.S. Court of Appeals for the Eighth Circuit reversed the decision of the district court.  It held that although HCV "is unquestionably a serious medical problem" for purposes of the Eighth Amendment analysis, plaintiff had failed to present evidence that would permit a finding of deliberate indifference.  It noted that confusion among the treating physicians about whether and when to order interferon treatment constituted negligence, not actionable under the Eighth Amendment.  It remanded the case to the district court.  385 F.3d 1133.  On remand, on November 18, 2004, the district court entered judgment in defendants' favor, in light of the Eighth Amendment's decision, and closed the case.
