This case is about the constitutionality of the Indiana Senate Enrolled Act 480 (SEA 480, or the “Act”), which went into effect on July 1, 2023 and prohibits transgender minors from receiving gender transition procedures. Represented by the ACLU of Indiana, the plaintiffs included four minor children and their parents, a family medicine practice that provided care to transgender persons, and a physician who co-founded that medical practice. On April 5, 2023, they sued the individual members of the Medical Licensing Board of Indiana, the executive director of the Indiana Professional Licensing Agency, the Attorney General of Indiana, and the Indiana Family and Social Services Administration and its Secretary. The plaintiffs brought this putative class action lawsuit in the United States District Court for the Southern District of Indiana under 42 USC § 1983, alleging that SEA 480 violated their First Amendment free speech rights, Fourteenth Amendment due process and equal protection rights, the Affordable Care Act (ACA), and Medicaid participation requirements. The plaintiffs sought a declaration that SEA 480 was unlawful and unconstitutional, injunctive relief preventing the Act from going into effect, and attorneys' fees and costs. District Judge James Patrick Hanlon and Magistrate Judge Kellie M. Barr presided over the case.

Plaintiffs sought to represent three classes and two subclasses. Class 1 consisted of all minors in Indiana diagnosed with gender dysphoria, receiving care that fell within SEA 180's definition of “gender transition procedures.” Subclass 1-A consisted of all members of Class 1 who received Medicaid. Class 2 consisted of all parents or legal guardians of minors in Indiana who were diagnosed with gender dysphoria, and received gender transition procedures. Class 3 consisted of all physicians and practitioners in Indiana who provided gender transition procedures. And Subclass 3-A consisted of all members of Class 3 who are Medicaid providers.

On April 6, 2023, the plaintiffs moved for a preliminary injunction to prevent SEA 480 from taking effect on July 1, 2023. That same day, they also moved to certify the three proposed classes and two proposed subclasses. On April 26, 2023, the defendants moved to stay the briefing on the motion for class certification until the motion for preliminary injunction was resolved. On May 5, 2023, the court ordered the plaintiffs to show cause for why their class certification should not be stayed, noting that the issue of class certification was inappropriate at the pleading stage because courts could provide broad relief via preliminary injunction without certifying a class, and therefore could effectively issue a class-wide injunction before considering whether the certification would be granted. The plaintiffs responded to the motion to show cause on May 11, 2023. On May 17, 2023, the court granted the defendants' motion to stay the class certification briefing until the preliminary injunction was resolved.

On June 2, 2023, the defendants responded to the plaintiffs' motion for preliminary injunction. On June 16, 2023, the court granted in part and denied in part the motion for preliminary injunction. The court denied the motion as to SEA 480's ban against gender reassignment surgeries for minors, which it permitted to take effect reasoning that the plaintiffs lacked standing to challenge the ban as there were no minors in the State who had ever been provided such surgery. The court granted the motion in part, however, prohibiting the State from enforcing SEA 480's prohibitions on (1) providing gender transition procedures for minors, outside of gender reassignment surgery, and (2) speech that would aid or abet gender transition procedures for minors. The court held that the plaintiffs had carried their burden of showing some likelihood of success on their claims that SEA 480 would violate their equal protection rights because the statute applied sex as the basis by which the law distinguishes between those who may receive certain types of medical care, and their free speech rights because it prohibited medical providers from making referrals or providing information about gender transition procedures. The court also found that the plaintiffs had shown that they would suffer irreparable harm in the form of mental distress resulting from minors not being able to take puberty blockers or hormone therapy, and because violations of the First Amendment are presumptively considered irreparable.

On July 11, 2023, the defendants appealed the preliminary injunction to the United States Court of Appeals for the Seventh Circuit. Many organizations, municipalities, and states submitted amicus briefs to the Seventh Circuit. Notably, the United States submitted its own amicus brief in support of the plaintiffs, arguing that SEA 480 is subject to heightened scrutiny and that the district court did not abuse its discretion in finding that SEA 480 is unlikely to survive heightened scrutiny. After all of the briefing was submitted, the Seventh Circuit scheduled oral argument for February 16, 2024. Discovery continued while the appeal was pending. 

On January 23, 2024 the Court granted Plaintiff's motion for class certification. The Court granted the motion certifying three classes and two subclasses of minor patients, parents, and medical providers. The classes certified were the Minor Patient Class, the Medicaid Patient Subclass, the Parent Class, the Provider Class, and the Medicaid Provider Subclass. 

As of February 2024, this case is ongoing.

ENTRY AND ORDER FROM TELEPHONIC DISCOVERY CONFERENCE - The Parties, by counsel, appeared for a Telephonic Discovery Conference on the record with the Magistrate Judge on October 2, 2023. The Court scheduled this conference after counsel jointly reached out to chambers with a discovery dispute that they could not resolve after meeting and conferring in good faith. [Dkt. 95.] Counsel Kenneth Falk appeared at the conference on behalf of Plaintiffs. Counsel James Barta, Katelyn Doering, and Melinda Holmes appeared on behalf of Defendants. Counsel Mark Sniderman appeared at the conference for Non-Parties GenderNexus and Gender Expansive Kids & Company ("GEKCO"). Mr. Sniderman represented that he is the only attorney intending to enter his appearance on behalf of these Non-Parties in this case at this time, and the Court directed him to file an appearance in this case as soon as practicable. The Court and counsel discussed at length the discovery dispute issues raised in the Joint Submission filed by Defendants and GenderNexus, [dkt. 99], and in the Joint Submission filed by Defendants and GEKCO, [dkt. 98]. After hearing counsel's arguments regarding the discovery disputes at issue, the Court ORDERS Defendants to continue to meet and confer with counsel for GenderNexus and GEKCO in an effort to reach an agreement on the disputes raised. The Parties and Non-Parties should keep in mind the protection offered by the Stipulated Protective Order, [dkt. 39], when discussing potential solutions.
