On November 30, 2022, undergraduate students at Yale University and Elis for Rachael, a nonprofit organization that supports students who have a mental health disability, filed this putative class action lawsuit in the United States District Court for the District of Connecticut. The plaintiffs sued Yale University under the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, the Fair Housing Act, and Section 1557 of the Patient Protection and Affordable Care Act. Represented by Disability Rights of Connecticut, the Bazelon Center for Mental Health Law, and private counsel, the plaintiffs sought class certification, injunctive and declaratory relief, and attorneys' fees. They argued that Yale’s policies discriminated against students with mental health disabilities. Specifically, they claimed that Yale’s withdrawal policies and practices caused students with mental health disabilities to leave the school, punished students who withdrew from the school, and made it difficult for students to come back after withdrawing. They also argued that Yale failed to provide sufficient accommodations in coursework and housing for students with disabilities. The case was assigned to Judge Michael P. Shea.

On December 7, 2022, the parties jointly asked the court to stay all proceedings in the case so they could engage in settlement discussions, and requested a settlement conference. The court granted the motion two days later, and the case was randomly assigned to Magistrate Judge Thomas O. Farrish for a settlement conference.

The parties met for settlement conferences on January 9 and 19, 2023. The stay was extended a few times to accommodate additional settlement proceedings throughout 2023.

On August 25, 2023, the parties filed a joint motion for settlement. In the settlement, Yale agreed to various policy changes. These included changes to its medical leave of absence policies, degree requirements, and accommodations process, as well as training on implementing the settlement and the publication of relevant data. The parties also agreed to negotiate payment of the plaintiffs’ costs and fees and agreed to a dispute resolution clause. The settlement provided that the court would retain jurisdiction for three years to resolve any potential disputes. The court granted the joint motion on August 28, 2023, and dismissed the case with prejudice on October 4, 2023.

As of April 4, 2024, there have been no updates to the case.
