ORDER. The parties' 23 Consent Motion to Stay and Referral for Settlement Conference is GRANTED. This case is hereby REFERRED to a Magistrate Judge for an early settlement conference and STAYED for 30 days, i.e., until January 9, 2023. The case is NOT automatically referred to Magistrate Judge Vatti for settlement. Magistrate Judge Vatti was assigned to the case at the outset (along with the undersigned) in the event the undersigned refers case-related tasks to a Magistrate Judge (e.g., any discovery disputes). Settlement conferences, however, are assigned randomly from a settlement "wheel," and usually result in the case's being assigned to a Magistrate Judge other than the assigned Magistrate Judge. The Court understands that the parties hope to a have a settlement conference promptly. After the case is randomly assigned to a Magistrate Judge for settlement purposes, the undersigned will inquire of the randomly assigned judge whether that judge's schedule would permit a prompt settlement conference. The parties shall file a joint status report regarding the status of the case no later than January 9, 2023. Signed by Judge Michael P. Shea on 12/9/2022. (Davis, Christina) (Entered: 12/09/2022)

ORDER: Telephonic pre-settlement conference set for December 15, 2022 at 11:00 a.m. before Judge Thomas O. Farrish. Please call in to the Court's conference call line at 1-888-557-8511 and enter the pass code of 4478772# when prompted. A date for the settlement conference will be set during the telephone call. Because the parties will likely be ordered to attend the conference, either in-person or via videoconference, counsel are instructed to obtain their client's schedules over the next ninety days and have them available during the pre-conference. Counsel should also have their own calendars available to aid in scheduling. During the telephone call, counsel should be prepared to discuss what, if any, information needs to be exchanged and anything else that needs to be accomplished prior to the settlement conference to maximize its chances of success. If either counsel has a firm, unavoidable conflict at the appointed date and time, e.g., a previously-scheduled appearance in another court, s/he should not file a motion for continuance on the docket but rather should call Chambers at 860-240-3605 as soon as possible with opposing counsel on the line to work out an alternate day and time for the pre-conference with Judge Farrish's law clerk. Signed by Judge Thomas O. Farrish on 12/12/22.(Wood, R.) (Entered: 12/12/2022)

ORDER re: Settlement Conference. Judge Farrish will hold a settlement conference in this case on January 9, 2023 at 9:00 a.m. and, if that conference does not result in a resolution, a second conference on January 19, 2023 at 9:00 a.m. Both conferences will begin in the East Courtroom of the Hartford courthouse. Persons having authority to decide all issues that can reasonably be expected to arise are required to attend in person, and any party who breaches this requirement may be subject to sanctions. In preparation for the conference(s), the parties are ordered to do the following:* By close of business on December 20, 2022, plaintiffs' counsel shall send to defendant's counsel a carefully prepared list of the minimum information the plaintiffs feel they need from the defendant in order to have a productive settlement conference. If the defendant feels that the list is overbroad or unduly burdensome, or if it believes there is another reason why the information should not be provided at this time, the parties are directed to meet and confer in good faith in an effort to resolve the dispute. If they are unable to do so, they may request Judge Farrish's intervention by calling his law clerk at 860-240-3605 with opposing counsel on the line.* Plaintiffs' counsel shall transmit an initial settlement proposal to defendant's counsel by close of business on December 23, 2022.* Each party shall prepare two versions of a mediation statement, one to be provided to its opponent and one to be provided ex parte to Judge Farrish, by 5:00 p.m. on January 4, 2023. The version to be shared with the opponent shall include (a) the partys statement of the material facts; (b) the partys view of the applicable legal principles and how they apply to the case; and (c) the partys most recent settlement proposal. The version to be submitted ex parte to Judge Farrish shall include all of the foregoing, plus a candid statement of which elements of the settlement proposal the party is or is not willing to be flexible on; and if there are elements on which the party is unwilling to be flexible, a detailed explanation why. The ex parte version is limited to twenty pages exclusive of exhibits; if a party feels that exhibits are necessary to Judge Farrish's understanding of the case, it may attach a reasonable number. The ex parte mediation statement may be e-mailed to Judge Farrish at TOF_Settlement@ctd.uscourts.gov. It is so ordered. Signed by Judge Thomas O. Farrish on 12/15/22.(Wood, R.) (Entered: 12/15/2022)

ORDER granting 33 Consent Motion for an Extension of Interim Deadline and Request for Remote Settlement Conference. The plaintiffs' deadline for transmitting a settlement proposal to the defendants is extended to January 4, 2023. The Court sua sponte extends the deadline for submission of mediation statements to 5:00 p.m. on January 5, 2023, so that the parties may address the plaintiffs' proposal in their respective submissions. As to the remote conference, Judge Farrish's courtroom deputy will send the Zoom connection information to appearing counsel via a Microsoft Outlook calendar invitation. Counsel are directed to forward the connection information to their principals, and otherwise to ensure that the principals are able to participate, e.g., that they will be in a location with a good wi-fi connection, that they have working webcams, etc. Signed by Judge Thomas O.
