On April 28, 2020, a group of plaintiffs, including a family clinic, medical professionals, private citizens, and pro-life organizations, filed a complaint in the U.S. District Court for Minnesota against the Governor of Minnesota, the State’s Commissioner for the Department of Health, and several health clinics. The plaintiffs took issue with the State’s decision to allow surgical abortions to continue when medication abortion remained available. The plaintiffs claimed this not only wasted personal protective equipment (PPE), but also aggravated the spread of COVID-19 by undermining Minnesota's social-distancing efforts. As a result, the plaintiffs sought declaratory and injunctive relief on grounds that the State’s decision was a violation of the 14th Amendment’s Equal Protection Clause, for they contended the State’s actions discriminatorily burdened the exercise of fundamental rights, including the practice of religion and to peaceably assemble while categorically exempting abortion. The plaintiffs also claimed that abortion was not a constitutional right, seeking declaratory judgment of the same. An amended complaint was filed on May 8, 2020, splitting the equal protection claim regarding PPE and social distancing into two distinct equal protection claims. The plaintiffs were represented by private counsel and Thomas More Society. The case was assigned to Chief Judge Patrick J. Schiltz. 

Amidst the COVID-19 pandemic, Governor Tim Walz of Minnesota issued an executive order that postponed all “non-essential or elective surgeries and procedures” that use personal protective equipment (PPE) to conserve limited resources. However, the state’s Department of Health refused to enforce the order against abortion providers, rather gave abortion providers “carte blanche to squander personal protective equipment on elective and unnecessary surgical abortions.” Governor Walz also issued an executive order prohibiting Minnesotans from exercising their constitutional rights to peaceably assemble and attend church services to enforce social distancing guidelines. However, this wasn’t applied in the surgical abortion context. 

On May 3, 2020, plaintiffs filed a motion for preliminary injunction to enjoin (a) defendant abortion clinics from performing surgical abortions, not including medication abortion and (b) the enforcement of executive orders that restrict elective surgeries, regulate PPE, restrict church attendance, or imposes social-distancing requirements, unless and until those orders are amended to prohibit surgical abortions. 

On May 26, 2020, defendant Walz filed a motion to dismiss the amended complaint on grounds that it failed to raise a claim upon which relief can be granted and for a lack of subject matter jurisdiction. The defendant health clinics separately moved to dismiss the amended complaint on the same day. 

Before the court could adjudicate the claims, the plaintiffs filed a notice voluntarily dismissing their action without prejudice on June 16, 2020. The case is considered closed.
