This is a case about whether the District of Columbia Department of Corrections (DOC) failed to provide constitutionally adequate health care to inmates in its detention facilities. On April 24, 2023, three individuals currently held in the Central Detention Facility and the Correctional Treatment Facility (“the Jail”) brought a putative class action lawsuit against the District of Columbia in the U.S. District Court for the District of Columbia. The case was assigned to Judge Colleen Kollar-Kotelly.

The complaint alleged that the District was deliberately indifferent to the plaintiffs’ serious medical needs. The plaintiffs suffered from a range of life-threatening health conditions, including, but not limited to, cardiovascular disease, kidney disease, HIV, AIDS, hepatitis C, tuberculosis, and more. The plaintiffs outlined four areas where the District was deficient in its duty to treat serious medical conditions: (1) properly screening for health care issues at intake, (2) promptly triaging patients’ medical needs, (3) providing medical supplies, and (4) promoting access to specialty care when necessary. As a result of these deficiencies, individuals with serious medical conditions routinely missed doses of life-saving medication and were forced to wait months or years for urgent medical care.

The plaintiffs defined the proposed class as “[a]ll people who are or will be incarcerated at the Jail who have serious medical needs.” The plaintiffs raised two claims under 42 U.S.C § 1983. First, the plaintiffs alleged that the District violated the Eighth Amendment’s prohibition on cruel and unusual punishment by subjecting inmates to a substantial risk of serious harm and injury from constitutionally inadequate health care. Second, the plaintiffs argued that the District violated the Fifth Amendment’s right to be free from punitive conditions because the District subjected pre-trial detainees ​​to the same medical care failures that violated the Eighth Amendment.

Represented by the Washington Lawyers’ Committee for Civil Rights & Urban Affairs and private counsel, the plaintiffs, on behalf of the proposed class, sought injunctive relief to stop the District from subjecting inmates to the described medical care failures, in addition to declaratory relief and the payment of attorneys’ fees. The plaintiffs also requested the U.S. District Court to maintain ongoing supervisory jurisdiction of the matter to monitor and enforce the defendant’s compliance with any ordered injunctive relief. Finally, one of the named plaintiffs requested compensatory damages.

The plaintiffs moved to certify their proposed class on April 27, 2023, and the District filed its answer on June 26, 2023. However, on July 18, 2023, both the plaintiffs and the defendant filed a joint motion to stay the motion for class certification, stating that they “believe[d] that pausing briefing on the [motion] while discovery occurr[ed] would be a more efficient use of their (and the Court’s) time.” Judge Kollar-Kotelly granted this motion on July 19, 2023, and stayed the motion for class certification.

The parties then turned to the issue of setting a date for the initial scheduling conference. Judge Kollar-Kotelly set the date for the initial scheduling conference on October 6, 2023, since both parties indicated that they wanted to explore the possibility of early mediation. On September 29, 2023, both parties filed a joint motion to refer the case to mediation. Judge Kollar-Kotelly granted the motion on October 2, 2023, and stayed the case until February 2, 2024.

On February 2, 2024, both parties submitted a joint status report, in which the parties indicated that they had participated in two mediation sessions, with a third scheduled for March 1, 2024. Accordingly, on February 5, 2024, Judge Kollar-Kotelly ordered that the case be stayed until June 3, 2024. On June 4, the case was further stayed until October 4, 2024. 

The case is still ongoing.
