This is a class action lawsuit filed in the U.S. District Court for the District of Maryland by inmates in a Baltimore County jail work-release program on January 5, 2021. This is a class action lawsuit filed in the U.S. District Court for the District of Maryland by inmates in a Baltimore County jail work-release program on January 5, 2021. Plaintiffs alleged that Baltimore County violated the Fair Labor Standards Act (FLSA) and Maryland Wage and Hour Law (MWHL) by failing to pay minimum wage and overtime pay for the hours they worked at the Department of Public Works recycling facility. This case was assigned to Judge Stephanie A. Gallagher. Plaintiffs sought unpaid wages, overtime compensation, liquidated damages, statutory damages, and attorneys' fees and costs. 

On April 23, 2021, the plaintiffs moved to certify their lawsuit as a collective action under the FLSA and a class action under Rule 23. The court granted conditional certification of the FLSA collective action on April 26, 2021, and later granted certification of the class on December 7, 2021. The following class was conditionally certified: Workers who, within the last three years of filing this lawsuit, have performed work for Baltimore County’s Department of Public Works at its Materials Recovery Facility in Cockeysville, Maryland through the work detail program of Baltimore County’s Department of Corrections, and who have not received at least $7.25/hour (and $10.87/hour when working over 40 hours in a single workweek)) for their labor.  

On October 17, 2021, defendants filed a motion for summary judgment. The defendants argued that plaintiffs could not be classified as "employees" under the FLSA and thus they were not entitled to minimum wage and overtime pay. Furthermore, they asserted that even if plaintiffs could be deemed as "employees", there is no evidence that defendants willfully violated employment laws. Following this, on November 23, 2023, plaintiffs filed a cross-motion for summary judgment. They argued that employment exists due to the working relationship between the parties, and thus the FLSA applies.

On June 9, 2023, the district court granted summary judgment in favor of the defendants and denied the plaintiffs cross-motion for summary judgment. The court agreed with the defendants that the plaintiffs were not employees and as such, they held that plaintiffs' claims fail as a matter of law. The court reasoned that the plaintiffs' work-release program served both a rehabilitative purpose and a economic purpose but stated that the rehabilitative purpose weighed against a finding of an economic relationship. 

On July 7, 2023, plaintiffs appealed the summary judgment order to the Fourth Circuit Court of Appeals. They argued that the district court erred in its application of Harker v. State Use Indus. Additionally, they argued that the district court did not properly apply the "economic realities" test and issues of material fact remained. On May 8, 2024, the Court of Appeals vacated the district court's decision and remanded the case to the district court to reconsider whether plaintiffs could be considered "employees". The Fourth Circuit asserted that there is no rule that excludes incarcerated works from being covered by FLSA, and the district court needed to assess the "economic reality" of this situation.

Following the Fourth Circuit's ruling, the plaintiffs petitioned for a rehearing en banc, which the court subsequently denied on June 6, 2024.

There is a settlement conference scheduled for April 2025, and trial is set for November 2025. The case is ongoing.
