The Regional Director of the National Labor Relations Board (NLRB) (“Petitioner”) filed this petition for a preliminary injunction under Section 10(j) of the National Labor Relations Act (NLRA), along with a labor union representing Starbucks' employees, against Starbucks in the U.S. District Court for the Eastern District of Michigan on November 15, 2022. The case was assigned to U.S. District Judge Mark Goldsmith. 

Petitioner claimed that Starbucks engaged in unfair labor practices within the meaning of Section 8(a)(1) and (3) of the NLRA, including the discharge of an employee who was the lead organizer of the union. Petitioner sought injunctive relief enjoining and restraining Starbucks from (a) discharging employees at any of its stores supporting the union and (b) interfering with, restraining, or coercing employees in the exercise of union organization. In addition, Petitioner sought reinstatement of the employee who was previously discharged, a nationwide order for Starbucks to cease and desist from violating the NLRA, and for Starbucks to distribute physical and electronic copies of the order to all of its employees in all locations. 

This action was filed during the pendency of a parallel proceeding before the NLRB. (Case number 07-CA-292971.) On April 11, 2022, the Workers United union had filed charges with Starbucks before the NLRB; after a hearing in August 2022, the administrative law judge determined that Starbucks had violated various provisions of the NLRA, including Sections 8a(1) and (3).  Appeals of that decision remained pending while the district court considered the present petition.  

On February 23, 2023, the district court granted in part and denied in part the petition and denied Starbucks’ motion for order to show cause, finding that the Petitioner had shown reasonable cause to believe that Starbucks had violated the NLRA when it discharged the lead union organizer. The court granted the Petitioner’s request for Starbucks to reinstate the discharged employee. Although the Petitioner had sought a nationwide cease and desist order distributed to all locations, the court narrowed the request to apply to the Ann Arbor, Main Street store only. 2023 WL 2186563. 

On February 28, 2023, Starbucks appealed to the U.S. Court of Appeals for the Sixth Circuit and sought a stay of the district court’s order for injunctive relief in the district court. On March 6, 2023, the district court denied Starbucks’ motion for a stay, reasoning that the termination of the lead union organizer had a chilling effect on other employees and that Starbucks did not demonstrate that injunctive relief was improper. 2023 WL 2368702. 

On August 23, 2023, the Petitioner filed a letter with the district court explaining that the injunctive relief granted by the district court was “ancillary to” the administrative proceeding before the NLRB (case number 07-CA-292971). Under the NLRA, a district court injunction can only last until a final decision by the NLRB in an administrative proceeding. The NLRB had issued its final administrative decision on August 9, 2023. As a result, Petitioner asserted, the injunction in the district court had terminated as a matter of law on that date; the Petitioner therefore requested the court close the case. 

On August 25, 2023, Starbucks filed a response to the Petitioner’s August 23, 2023 letter to the district court. It argued that although it was not opposed to dissolving the injunction, it should be able to continue with its appeal of the preliminary injunction, which it deemed “inappropriate” and “not supported by evidence.”  

On September 5, 2023, Starbucks filed a motion to vacate the injunction and remand the case to the district court, while seeking to preserve its right to argue that a final decision of the NLRB in an underlying administrative proceeding does not, without more, moot appeal of a district court’s decision to grant relief under Section 10(j).  That same day, the Sixth Circuit directed that further briefing on the appeal would be held in abeyance pending a ruling on Starbucks’ motion. As of October 2023, the case is ongoing.
