On July 16, 2020, a transgender man, represented by the American Civil Liberties Union and private counsel, sued the University of Maryland Medical Systems Corporation (“UMMS”) in the U.S. District Court for the District of Maryland. The plaintiff was scheduled to have a hysterectomy as part of his gender-affirming care prescribed by his doctor at UMMS-owned St. Joseph Medical Center (“SJMC”), a Catholic institution bound by the Ethical and Religious Directives for Catholic Health Care Services. SJMC cancelled the plaintiff’s procedure, because according to their directive, SJMC was “prohibited from performing procedures that result in sterilization or impact the functional integrity of the human body, regardless of gender or gender-identity.” The plaintiff alleged that since SJMC is part of a taxpayer-funded hospital system, they are subject to the Establishment Clause of the First Amendment, Equal Protection Clause of the Fourteenth Amendment, and the Affordable Care Act (“ACA”), and that their actions violated those Clauses and Act. The plaintiff sought declaratory relief and compensatory and nominal damages. The case was assigned to District Judge Ellen L. Hollander.

On September 25, 2020, UMMS filed a motion to dismiss with prejudice arguing that the plaintiff lacked standing, the medical system is a private corporation that could not violate the plaintiff’s constitutional rights, and even if the medical system was a state actor, the plaintiff’s claim would be barred by sovereign immunity. On May 28, 2021, this case was reassigned to District Judge Deborah K. Chasanow.

On July 28, 2021, Judge Chasanow granted in part and denied in part UMMS’ motion to dismiss, while also dismissing without prejudice parts of the plaintiff’s complaint. Judge Chasanow found that the plaintiff did have standing to bring this suit and has stated a claim for sex discrimination under the ACA, but UMMS was shielded by sovereign immunity concerning the Establishment Clause and Equal Protection Clause claims.

On June 24, 2022, UMMS filed a motion for summary judgment arguing three points. First, UMMS is not the proper defendant, because only the federal funding recipient for the discriminatory program, SJMC, can be held liable. Second, the plaintiff’s ACA claim was barred by the U.S. District Court for the District of North Dakota, in Religious Sisters of Mercy v. Azar, when the court granted summary judgment to a Catholic employer who refused to provide gender-affirming care. And lastly, if nothing else, the plaintiff was denied the hysterectomy, not because of the plaintiff’s gender-identity, but because SJMC would not perform a hysterectomy on any patient who sought one without a sufficient medical basis under the Catholic directives.

In response, on July 25, 2022,  the plaintiff also filed for a motion for summary judgment arguing three points. First, UMMS’ denial of care violated the ACA because the plaintiff was denied on the basis of sex. Second, UMMS is the correct defendant because courts have consistently refused to let  governments hide behind the corporate form to evade liability. Lastly, the injunction from Religious Sisters of Mercy v. Azar did not insulate SJMC from liability because that injunction only applies to the federal government, which did not affect the scope of the private right of action.

On January 6, 2023, Judge Chasanow granted the plaintiff's motion for summary judgment. First, the court found that the cancellation of plaintiff’s surgery was discrimination on the basis of sex because SJMC’s policy allowed all patients to receive medically necessary hysterectomies, except for transgender patients. Second, because UMMS wholly owns and operates a hospital that adheres to discriminatory policies, UMMS can be held directly liable. Lastly, parties would not be bound under the injunction in Religious Sisters of Mercy v. Azar because of how differently the parties in this case’s position compared to the parties in the other case.

On February 3, 2023, UMMS agreed to pay the plaintiff $872.81 through March 1, 2023, and $0.14 every day thereafter until final judgment was entered. On March 13, 2023, Judge Chasanow entered the judgement in favor of the plaintiff, for a total of $874.63.

On April 10, 2023, the plaintiff appealed to the Fourth Circuit Court of Appeals for the earlier dismissal of his claims that the cancellation of his surgery violated the Establishment Clause and the Equal Protection Clause. 

On April 14, 2023, UMMS filed a motion to dismiss the appeal arguing that the Court of Appeals lacked jurisdiction because the plaintiff was arguing for the same relief he already received on statutory grounds and UMMS had since paid the judgment. Therefore, there was no live controversy and this appeal was moot. On July 17, the Court of Appeals deferred action on the motion to dismiss appeal.

On August 1, 2023, the Court of Appeals granted plaintiff’s motion for abeyance pending a decision by Fourth Circuit in Fain v. Crouch. On April 29, 2024, the Fourth Circuit decided in Fain v. Crouch that healthcare plans that provide medically necessary care for certain diagnoses but denies that same care to conditions unique to transgender patients violated the Equal Protection Clause and other federal law. 

On August 19, 2024, the Court of Appeals renewed their deferral of action on the motion to dismiss appeal.

This case is ongoing as of February 22, 2025.
