This is a case about the constitutionality of Westchester County’s Reproductive Health Care Facilities Access Act (RHCFAA), which restricts a range of activities outside of abortion clinics, including engaging in sidewalk counseling with passersby. On August 15, 2022, plaintiffs, two individuals actively engaged in pro-life sidewalk outreach, filed this lawsuit in the U.S. District Court for the Southern District of New York. The plaintiffs brought this pre-enforcement challenge against Westchester County under 42 U.S.C. § 1983, challenging seven provisions of the RHCFAA. On December 15, 2022, plaintiffs filed a second amended complaint adding two pro-life organizations — 40 Days for Life and White Plains 40 Days for Life — as additional plaintiffs. Represented by the Thomas More Society, the plaintiffs jointly sought a declaration that the act was unconstitutional, injunctions preventing enforcement of the law as well as enjoining defendants from preventing plaintiff from counseling outside of abortion clinics, and nominal damages. The plaintiffs claimed that the RHCFAA made sidewalk counseling impossible without risking criminal or civil liability; consequently, they had to suspend their efforts. This case was assigned to District Judge Philip M. Halpern and Magistrate Judge Judith C. McCarthy.

On February 3, 2023, plaintiffs filed an interlocutory appeal from the District Court’s effective denial of plaintiff’s motion for injunctive relief against one provision of the RHCFAA, § 425.31 (i). Plaintiffs claimed that, during a pre-motion conference, the District Court stated its determination that a related case, Vitagliano v. County of Westchester, which upheld the same provision of the RHCFAA, would control this case as well. On July 12, 2023, the Second Circuit dismissed the appeal for lack of jurisdiction, reasoning that the District Court’s statement during the pre-motion conference did not qualify as an effective denial of the plaintiffs’ motion for injunctive relief. 

While the appeal on § 425.31 (i) was pending, the District Court issued an order on April 24, 2023, denying plaintiffs’ request for a preliminary injunction against the remaining six provisions (§§ 425.31 (a), (c), (e), (d), (f), and (h)). The court first terminated White Plains 40 Days for Life and 40 Days for Life as parties to this case for lack of standing. The court then held that the individual plaintiffs lacked standing to challenge all but one of the RHCFAA sections and, for that remaining section, nonetheless failed to meet their burden of proof with regard to the preliminary injunction standard. On May 15, 2023, plaintiffs filed an interlocutory appeal challenging the court’s decision. The case is ongoing.

ORDER: One of the pending pre-motion conference letters concerns Plaintiffs' anticipated motion for leave to proceed under pseudonymsa motion that must be granted for summonses to issue for the Complaint in its current state. (See Doc. 9; Doc. 16; see Aug. 19, 2022 Entry). The premotion conference requirement is waived for this application and Plaintiffs are granted leave to serve and file their pseudonym motion in accordance with the following schedule: (1) Plaintiffs' motion papers shall be served on all Defendants and filed on September 30, 2022; (2) Defendants (to the extent any wish to be heard on an application before summonses have issued) shall serve and file their opposition papers on October 14, 2022; and (3) Plaintiffs' reply papers, if any, shall be served and filed on October 21, 2022. Per County Counsel John Nonnas representation yesterday, confirmed in a telephone conversation with him today, the County has no objection to the entry of such an order. ENDORSEMENT: Application denied. The Court finds no basis in law to bifurcate the motion for preliminary injunction as Plaintiffs request. The Court will consider Plaintiffs' request for preliminary injunctive relief as to all of the challenged provisions of Section 425.31 once the motion is sub judice. SO ORDERED.
