In March 2023, the Kentucky legislature voted to override Governor Andy Beshear’s veto and enact Senate Bill 150 (“SB 150”). Set to take effect on June 29, 2023, SB 150 prevented healthcare providers from using puberty blockers and hormone therapy to treat transgender patients under the age of 18. On May 3, 2023, seven transgender minors and their parents filed this lawsuit in the U.S. District Court for the Western District of Kentucky against several state officials in their official capacities under 42 U.S.C. § 1983. Six of the minors had already begun receiving treatment for their gender dysphoria, and the seventh intended to receive treatment once she began puberty. Plaintiffs were represented by the ACLU of Kentucky, the National Center for Lesbian Rights, and Morgan, Lewis & Bockius, LLP.

In their complaint, Plaintiffs brought two claims: First, Plaintiffs argued that SB 150 would violate the Due Process Clause of the Fourteenth Amendment by preventing parents from exercising their fundamental right to obtain medically necessary care for their minor children. Second, Plaintiffs claimed that SB 150 would violate the Equal Protection Clause of the Fourteenth Amendment because it discriminated on the basis of sex and transgender status by prohibiting certain medical treatments only for transgender patients.

Plaintiffs sought a declaratory judgment that SB 150 was unconstitutional under the Fourteenth Amendment; preliminary and permanent injunctions enjoining Defendants from enforcing SB150; and costs and expenses, including reasonable attorneys’ fees. The case was randomly assigned to Judge Rebecca Grady Jennings, and after she recused herself, reassigned to Judge David J. Hale.

On May 17, 2023, the state of Kentucky moved to intervene as a defendant. The trial court granted the motion the following month.

On May 22, 2023, Plaintiffs motioned for a preliminary injunction, and shortly thereafter, the United States filed a Statement of Interest, advising the Court that denying transgender minors access to medically necessary and appropriate care violated the Equal Protection Clause. Then, on June 28, 2023, the court granted Plaintiffs’ motion for a preliminary injunction. The court stated that SB 150 discriminated on the basis of sex because a minor’s sex at birth determined whether they could receive certain types of medical care under the law and noted that the state had not presented a sufficiently persuasive justification for this difference in treatment. 679 F.Supp.3d 576. Further, the court pointed out that while the state itself had acknowledged parents’ substantive due process right to direct their children’s medical care, the state had not even attempted to show that SB 150 employed the least restrictive means necessary to achieve its stated interests. As such, the court enjoined Defendants from enforcing, threatening to enforce, or otherwise requiring compliance with SB 150 until a final judgment was reached.

In response, the state of Kentucky filed a motion to stay the preliminary injunction and an appeal of the decision. On July 8, 2023, the U.S. Court of Appeals for the Sixth Circuit stayed the preliminary injunction in L.W. v. Skrmetti, a similar case brought by three families and a physician in Tennessee. The Sixth Circuit additionally consolidated Skrmetti with this case for the purposes of appeal. On July 14, 2023, the trial court concluded that the Sixth Circuit’s stay of the injunction in Skrmetti required the trial court to grant the requested stay here in Doe. Noting that the Doe Plaintiffs’ requested stay presented the same issues as decided in Skrmetti, the Sixth Circuit declined to lift the district court’s stay on July 31, 2023. Plaintiffs petitioned for an en banc rehearing, which the Sixth Circuit denied on September 12.

On September 28, 2023, the Sixth Circuit reversed the preliminary injunctions issued in Doe and Skrmetti and remanded the cases for further proceedings consistent with its decision. In its opinion, the Sixth Circuit questioned whether gender-affirming treatments adopted over the last few decades should be accepted as treatments for minors and argued that judges “should be humble and careful about announcing new substantive due process or equal protection rights that limit accountable elected officials from sorting out these medical, social, and policy challenges.” 83 F.4th 460.

Plaintiffs filed a petition for certiorari with the U.S. Supreme Court on November 1, 2023, and the Supreme Court agreed to hear the case on June 24, 2024 (docket no. 23-477). This case is currently ongoing, with oral argument at the Supreme Court scheduled for December 4, 2024.
