This is a case about the Las Vegas Metropolitan Police Department's failure to provide reasonable accommodations to deaf people incarcerated pre-trial, post-conviction, and on parole. Plaintiff, a deaf individual who was incarcerated at the Clark County Detention Center (CCDC), the largest jail in Nevada, filed suit on January 11, 2024 in the U.S. District Court for the District of Nevada. Plaintiff, represented by the American Civil Liberties Union of Nevada, the National Association of the Deaf, and private attorneys, alleged that the Las Vegas Metropolitan Police Department failed to accommodate his hearing disability, per requirements under the Americans with Disabilities Act (ADA), Eighth Amendment, and the Nevada Constitution. The case was assigned to District Judge Anne R. Traum and Magistrate Judge Maximiliano D. Couvillier, III.
Plaintiff spent over two years incarcerated in the CCDC, much of which occurred during the height of the COVID-19 pandemic. Plaintiff filed suit seeking the installation of videophones at the CCDC to replace outdated TTY phone technology; the provision of ASL interpreters for medical appointments, religious services, disciplinary hearings, and other events; the proper training of CCDC staff on how to work with deaf people; the provision of any other necessary aids or services deaf people may need; appropriate compensation for Plaintiff; and attorneys’ fees.
