On September 13, 2021 a member of the LGBTQ community brought a lawsuit against Aetna Inc. over the insurance company’s policy regarding access to fertility treatment. Represented by private counsel and the National Women’s Law Center, the plaintiff brought suit in the Southern District of New York, seeking a class action.

 The plaintiff alleged that Aetna’s health insurance policy engaged in sex discrimination under the Affordable Care Act and New York State Law, by denying LGBTQ individuals equal access to fertility treatments. Plaintiff alleged that Aetna’s policy required individuals who cannot conceive due to their sexual orientation or gender identity to pay out of pocket for 12 months before Aetna will provide coverage for fertility treatments while cisgender and heterosexual couples are provided with immediate coverage if they have not gotten pregnant after having unprotected sex for 12 months. The plaintiff sought declaratory and injunctive relief as well as compensatory and punitive damages. The case was assigned to Judge Vernon Broderick.

On November 5, 2021, the plaintiff filed an amended complaint adding other women as plaintiffs to their lawsuit. 

On June 21, 2023 the parties filed a joint motion to stay the case while they discussed a settlement agreement. Subsequent motions to stay the case were issued until the parties reached a proposed settlement agreement on April 18, 2024. On October 10, 2024 the court granted the proposed settlement agreement, and it approved the final settlement agreement on November 4, 2024. 

The settlement agreement stipulated that Aetna would update its policies to ensure that fertility treatments will be applied and administered in a non-discriminatory manner, regardless of the individuals’ sexual orientation. The settlement agreement also created three categories of individuals who could receive damages from the settlement:

  • Category A which comprised of individuals "whose Aetna member files contain one of an agreed-upon set of qualifying IUI or mixed IUI and IVF codes associated with precertification or claim requests";
  • Category B is comprised of individuals "whose Aetna member files contain one of an agreed-upon set of qualifying IUI codes associated with precertification or claim requests ... but for whom Aetna cannot determine from its member files whether they were in an Eligible LGBTQ+ Relationship during the Class Period."
  • Category C is comprised of individuals "whose Aetna member files contain one of an agreed-upon set of qualifying IVF-only codes associated with precertification or claim requests during the Class Period, but for whom Aetna cannot determine from its member files their IUI history and whether they were in an Eligible LGBTQ+ Relationship during the Class Period."

Category A individuals are automatically entitled to damages; while categories B and C are entitled to damages upon submission of an attestation. Class members received a default reimbursement of $2,300, with the ability to show that they are entitled to more. Class members could also receive compensation from a $2 million common fund for other pecuniary and non-pecuniary damages. 

The Court retains jurisdiction over the settlement for 4 years. 

As of February 10, 2025, the case is ongoing.
