This lawsuit challenges the enforcement of a rule adopted by the US Department of Health & Human Services on May 6, 2024 (the “2024 Rule”) interpreting Section 1557 of the Affordable Care Act (ACA), which prohibits sex discrimination in healthcare programs. This lawsuit challenges the enforcement of a rule adopted by the US Department of Health & Human Services on May 6, 2024 (the “2024 Rule”) interpreting Section 1557 of the Affordable Care Act (ACA), which prohibits sex discrimination in healthcare programs. The 2024 Rule interpreted Section 1557 of ACA—which borrows Title IX's definition of sex discrimination—to encompass protections against discrimination based on gender identity and other sex characteristics. The rule was set to go into effect on July 5, 2024. 

On May 30, 2024, Tennessee, Mississippi, Alabama, Georgia, Indiana, Kansas, Kentucky, Louisiana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Virginia, and West Virginia filed this lawsuit in the U.S. District Court for the Southern District of Mississippi. Plaintiffs sued the U.S. Department of Health and Human Services (HHS), the HHS Secretary, the Director of the HHS Office for Civil Rights, the Centers for Medicare and Medicaid Services, and the Administrator of the Centers for Medicare and Medicaid Services.

Plaintiffs brought suit under the Administrative Procedure Act (APA), arguing that the 2024 Rule violated the APA and the US Constitution. Specifically, Plaintiffs argued that the Rule's interpretation of “on the basis of sex” was contrary to the language of the ACA and Title IX and violated the assumption that Congress will not intrude on states' authority to regulate medicine without a clear statutory directive. They also alleged that the Rule was arbitrary and capricious, in violation of the APA. Plaintiffs also argued that the 2024 Rule violated the US Constitution because conditions on federal funds under the Spending Clause must be imposed unambiguously by Congress, which was not the case here. Further, they argued that the Rule violated the nondelegation doctrine by interpreting HHS to have legislative powers that belong to Congress. Finally, Plaintiffs argued that the 2024 Rule was an invalid federal waiver of state sovereign immunity, in violation of the Eleventh Amendment. Plaintiffs sought a declaratory judgment, vacatur of the 2024 Rule, and a preliminary and permanent injunction. The case was assigned to Judge Louis Guirola.

On June 13, 2024, Plaintiffs moved for a preliminary injunction and expedited consideration. The following month, on July 3, the court granted a nationwide preliminary injunction against the 2024 Rule as it pertained to gender identity discrimination, holding that Plaintiffs were substantially likely to succeed on their claim that HHS's interpretation violated the meaning of the ACA. According to the court, the substantial cost of compliance with the 2024 Rule weighed in favor of maintaining the pre-Rule status quo. 2024 WL 3283887.

On August 30, 2024, Defendants appealed the court’s order granting the preliminary injunction to the U.S. Court of Appeals for the Fifth Circuit. On September 25, 2024, Defendants filed a motion in the district court to stay proceedings while the appeal was pending. 

As of November 23, 2024, the motion to stay proceedings in the district court and the appeal in the Fifth Circuit remain pending.
