This is a case about wage discrimination between nurse practitioners (NP) and other comparable jobs such as physicians and psychiatrists.

On September 17, 2024, NPs employed by New York, filed this class-action lawsuit in the United States District Court Northern District of New York. The plaintiffs sued the State of New York and the New York State Civil Service Commission under Title VII of the Civil Rights Act of 1964. Represented by private counsel, the plaintiffs sought back wages for the past ten years, damages for the distress caused by the longstanding discriminatory practice, commensurate adjustment of pension benefits, and implementation of a series in their new title. They claimed that, in violation of Title Vll, the defendants have maintained the lower classification for NPs, most of whom are female, and have been paying them less than other comparable jobs with higher grades, which females do not dominate, despite similar responsibility and complexity in the NPs’ jobs.

On November 19, 2024, the defendants filed the motion to dismiss. 

The case is ongoing.
