On January 21, 2025, in the first week of the second Trump Administration, the Department of Homeland Security rescinded its "sensitive locations" policy, under which houses of worship were deemed inappropriate for immigration enforcement actions.  This case, brought by Philadelphia Yearly Meeting of the Religious Society of Friends, New England Yearly Meeting of the Religious Society of Friends, Baltimore Yearly Meeting of the Religious Society of Friends, Inc., Adelphi Friends Meeting of the Religious Society of Friends, and Richmond Friends Meeting of the Religious Society of Friends who are represented by Democracy Forward, challenged that change, alleging that it violated the First Amendment, the Religious Freedom Restoration Act, and the Administrative Procedure Act. The plaintiffs filed the complaint against both the Department of Homeland Security and the acting Secretary of the Department of Homeland Security, and they sought declaratory and injunctive relief, as well as attorneys' fees. They filed this case on January 27, 2025, in the U.S. District Court for the District of Maryland; it was assigned to Judge Theodore D. Chuang. The plaintiffs filed an amended complaint on February 5, 2025, which added Cooperative Baptist Fellowship and Sikh Temple Sacramento as plaintiffs.

On February 4, 2025, the plaintiffs sought a temporary restraining order and preliminary injunction, arguing that the immigration-enforcement actions at houses of worship directly and substantially interfered with the plaintiffs' communal worship and therefore interfered with their right to gather for religious exercise. A hearing was held on Feb. 13, 2025. On February 24, 2025, Judge Chuang ruled on the preliminary injunction. He ordered that the defendants not act pursuant to the terms of the Memorandum of January 20, 2025 or the Memorandum of January 31, 2025–both of which rescinded the sensitive locations policy. Instead, the defendants were ordered to act pursuant to the Memorandum of October 27, 2021 in regards to the plaintiffs, which demanded that immigration practices at places of worship not be undertaken to the "fullest extent possible". The Preliminary Injunction Order held that Defendants were still allowed to conduct arrests in or near places of worship when authorized by an administrative or judicial warrant pursuant to 8 U.S.C. § 1252(f)(1).

On February 28, 2025, Judge Chuang granted the plaintiffs an extension of the deadline for providing the defendants with a list of all places of worship that were associated with the plaintiffs or file a motion for a protective order to March 4. However, on March 4, the plaintiffs expressed to Judge Chuang that they feared that the defendants would misuse this information and that their proposed changes to the proposed order would allow them to misuse this information. On March 6, 2025, Judge Chuang signed a protective order deeming all the information provided by the plaintiffs to be considered protected information and limited the use of the list provided by the plaintiffs.

On April 10, 2025, the Court granted the Defendants leave to file a Partial Motion to Dismiss by April 17, 2025. The case is ongoing.
