On February 10, 2025, the Association of American Medical Colleges (AAMC), the American Association of Colleges of Pharmacy (AACP), the Association for Schools and Programs of Public Health (ASPPH), the Conference of Boston Teaching Hospitals (COBTH), and the Greater New York Hospital Association (GNYHA) filed a lawsuit in the United States District Court for the District of Massachusetts against the National Institutes of Health (NIH) and the U.S. Department of Health and Human Services (HHS). The plaintiffs sought declaratory and injunctive relief, arguing that NIH’s decision to lower indirect cost reimbursements violated the Administrative Procedure Act, exceeded NIH’s statutory authority, and violated the Due Process Clause.

The dispute arose from an NIH policy issued on February 7, 2025, under Notice Number NOT-OD-25-068, “Supplemental Guidance to the 2024 NIH Grant Policy Statement: Indirect Cost Rates,” which capped indirect cost rates for NIH research grants at 15%. Historically, these costs—covering laboratory maintenance, compliance measures, and research infrastructure—were negotiated individually with each institution based on its actual expenses. The complaint emphasized that NIH’s new policy threatened the financial stability of teaching hospitals, medical schools, and research institutions, which rely on federal funding to support groundbreaking work in cancer treatment, public health, and pharmaceutical development. By overriding decades of negotiated funding agreements, the policy change could force institutions to shut down research programs, halt clinical trials, and lay off staff, jeopardizing public health and economic development. 

The plaintiffs alleged that NIH’s unilateral policy change violated the Administrative Procedure Act (APA), was arbitrary and capricious, exceeded NIH’s statutory authority, violated federal appropriations laws, and violated the Due Process Clause because it disregarded statutory requirements and retroactively imposed funding cuts on existing grants. The plaintiffs also argued that Congress had explicitly prohibited NIH from altering its reimbursement structure through annual appropriations riders, making the new policy illegal. The plaintiffs sought a declaration that the Rate Change Notice was unlawful. They also requested a temporary, preliminary, and permanent injunction barring implementation and enforcement of the Rate Change Notice.

The case was assigned to Judge Angel Kelley who also presided over two similar cases, Commonwealth of Massachusetts v. National Institutes of Health and Association of American Universities v. Department of Health & Human Services. On Feb. 10, the Plaintiffs filed an emergency motion for a temporary restraining order, which Judge Angel Kelley granted without a hearing on the same day. The TRO enjoined the Defendants from taking any steps to implement, apply, or enforce the Rate Change Notice until the Court issued a further order. After a hearing on February 21, 2025, the court extended the TRO pending a further ruling. 

That ruling came on March 6, 2025, when Judge Kelly granted a preliminary injunction.

On April 4, the defendants filed an assented-to motion to convert the preliminary injunction into a permanent injunction and file a final judgment. They argued there were no additional facts or legal questions to consider. The Court granted the motion on the same day. 

On April 8, the defendants filed a notice of appeal in the First Circuit.

Plaintiff American Association of Colleges of Pharmacy (“AACP”) advances pharmacy education, research, scholarship, practice and service, in partnership with our institutional and individual members and stakeholders, to improve health for all. Plaintiff Association of Schools and Programs of Public Health (“ASPPH”) is the voice of academic public health and trains the next generation of public health professionals, convenes leaders, generates evidence, and advocates for policies that improve the health and well-being of everyone, everywhere. Plaintiff The Conference of Boston Teaching Hospitals, Inc. (“COBTH”) is dedicated to fostering collaboration among its member teaching hospitals and supporting the full mission of its member institutions by ensuring high quality, accessible, and affordable care; advocating for policies that advance the missions of education, research, and the provision of specialized services; and working with government and local communities to protect the public health. Plaintiff Greater New York Hospital Association (“GNYHA”) represents the interests of approximately 200 hospitals and health systems primarily in New York State but also in New Jersey, Connecticut, and Rhode Island. All of GNYHA’s members are either not-for-profit, charitable organizations or publicly sponsored institutions that provide services ranging from state-of-the art, acute quaternary services to basic primary care needed by their communities. Many GNYHA members conduct significant research studies funded by the NIH, in conjunction with and separately from affiliated medical schools. To assist its members, GNYHA engages in advocacy, policy analysis, education, research, and communication services at the local State, and Federal levels. GNYHA also undertakes extensive activities in the health care regulatory area, participating actively in issues pertaining to hospitals and other health care entities, health planning, and requirements for establishing and operating health care facilities.
