ORDER: Plaintiff shall file a letter no longer than three pages on or before February 26, 2025, describing Plaintiff's efforts to serve Plaintiff's complaint and a summons on Defendant. If Plaintiff fails to file the letter required by this order, or if Plaintiff's letter demonstrates a lack of diligence in attempting service, then the Court is unlikely to extend the deadline for Plaintiff to complete service under Rule 4(m) in the absence of unusual circumstances demonstrating good cause. The Court will not extend the deadline for Plaintiff to file the letter required by this order unless Plaintiff requests an extension in accordance with Section I.D of the Court's Individual Practices. Ordered by Judge Hector Gonzalez on 2/5/2025. (KM)

Feb. 5, 2025

ORDER: The Court grants Defendant's motion for an extension of time, see ECF No. 11, and Defendant shall file an answer or otherwise respond to Plaintiff's complaint on or before March 14, 2025. The parties' deadline to file the joint letter and case management plan required by the Court's prior scheduling order, see ECF No. 8, remains March 17, 2025. As the parties do not dispute that service was effectuated on February 6, 2025, neither Plaintiff nor Defendant need file the service letter referenced in the Court's Order of February 5, 2025. Ordered by Judge Hector Gonzalez on 2/25/2025. (GEM)

Feb. 25, 2025

Feb. 25, 2025

ORDER: Defendant has filed a pre-motion letter in anticipation of a proposed motion to dismiss Plaintiff's complaint, see ECF No. 14, and Plaintiff has filed a responsive letter, see ECF No. 17 . Plaintiff shall file an additional letter on or before April 2, 2025, which shall address whether Plaintiff believes the complaint can be amended to address the issues raised in Defendant's letter. Ordered by Judge Hector Gonzalez on 3/26/2025. (GEM)

March 26, 2025

March 26, 2025

ORDER: The Court denies Defendant's request for a pre-motion conference, see ECF No. 14, because the Court deems a conference to be unnecessary. Defendant shall file opening papers in support of Defendant's motion to dismiss on or before April 28, 2025. Plaintiff shall file opposition papers on or before May 28, 2025, and Defendant shall file reply papers on or before June 11, 2025. The parties' motion papers shall comply with the page limits and other requirements described in Section IV.B of the Court's Individual Practices. Ordered by Judge Hector Gonzalez on 3/28/2025. (GEM)

March 28, 2025

March 28, 2025

ORDER: The Court grants the parties' joint request to extend all remaining discovery deadlines in the Court's scheduling order, see ECF No. 21, by 45 days, and to extend Defendant's deadline to reply to Plaintiff's opposition to its motion to dismiss or strike by 7 days, see ECF No. 24 . Given the significant time afforded by these new deadlines, any further extensions are unlikely in the absence of extraordinary circumstances demonstrating good cause, and the fact that the parties have been pursuing settlement negotiations will not by itself constitute good cause. Finally, the parties shall provide a joint status update on or before June 13, 2025, regarding the outcome of the mediation scheduled for June 10, 2025. Ordered by Judge Hector Gonzalez on 5/2/2025. (PN)

May 2, 2025

ORDER DISMISSING CASE: In light of the parties' letter, see ECF No. 26, which indicates that the parties have reached a settlement in principle, the Court dismisses this case with leave to reopen on or before July 14, 2025, if the parties' settlement is not finalized by then. Ordered by Judge Hector Gonzalez on 6/13/2025. (GEM)
