This case challenged Trump’s Executive Orders 14151 and 14173, which aimed to eliminate diversity, equity, and inclusion (DEI) programs. The plaintiffs were the Chicago Women in Trades (CWIT), a nonprofit organization that supports women entering skilled trades. They filed suit on February 26, 2025 in the United States District Court for the Northern District of Illinois against President Donald Trump, the U.S. Department of Labor, the U.S. Office of Management and Budget, the U.S. Department of Justice, and their respective agency heads. The case was assigned to Judge Matthey F. Kennelly. Plaintiff sought injunctive and declaratory relief, arguing that Trump’s Executive Orders 14151 and 14173 unlawfully targeted and eliminated DEI initiatives, violating the First and Fifth Amendments of the U.S. Constitution.

On January 20, 2025, President Trump issued Executive Order 14151, titled "Ending Radical and Wasteful Government DEI Programs and Preferencing." This order declared DEI-related programs illegal and directed federal agencies to terminate equity-related grants and contracts. The next day, he signed Executive Order 14173, titled "Ending Illegal Discrimination and Restoring Merit-Based Opportunity," which required all federal agencies to eliminate DEI references from federal contracting and grants. It also mandated that federal contractors and grant recipients certify that they did not operate DEI-related programs that violated federal anti-discrimination laws, subjecting them to False Claims Act liability if they failed to comply.

Plaintiff CWIT, which helps women—especially Black and Latina women—enter and remain in skilled trade industries, claimed they were directly affected by the Trump EOs. Plaintiff received significant federal funding, including through the Women in Apprenticeship and Nontraditional Occupations (WANTO) Grant and the Apprenticeship Building America (ABA) Grant. Following the executive orders, Plaintiff’s federal funding was frozen. The grant funding was eventually made available again following a Temporary Restraining Order in a separate litigation. See National Association of Diversity Officers in Higher Education v. Trump. However, the grants remained under threat of termination. The certification requirement forced Plaintiff to either risk losing its funding or sign a potentially fraudulent certification under False Claims Act liability. The vague, overbroad language of the executive orders left the organization uncertain about whether its programs would be considered unlawful DEI activities. Further, the executive orders created a chilling effect, forcing Plaintiff and similar organizations to reconsider their DEI-related work out of fear of government enforcement actions.

Plaintiff challenged the executive orders on multiple constitutional grounds. First, the lawsuit argued that the Termination Provisions, Certification Provision, and Enforcement Threat Provision violated the First Amendment for overbreadth, vagueness, and viewpoint discrimination by restricting and discriminating against a specific viewpoint that promoted DEI. Further, the orders violated the First Amendment for placing an unconstitutional condition on federal funds preventing plaintiffs from engaging in protected speech.  Second, Plaintiff alleged that the executive orders violated the Fifth Amendment's Due Process Clause for vagueness by failing to provide clear guidance on what DEI-related activities were now illegal. Without clear definitions, Plaintiff could not reasonably determine whether its federally funded programs complied with the new regulations, leaving it at risk of funding termination or civil penalties. Plaintiff also claimed the executive orders violated the Spending Clause because the orders directed subordinate executive branch officials to terminate funds without express statutory authority. Finally, Plaintiff argued the executive orders contradicted the constitutional Separation of Powers by dictating spending and placing conditions on money that was vested by the legislative branch. 

Plaintiff sought a declaration that both executive orders were unlawful and unconstitutional. It also requested a preliminary and permanent injunction enjoining the defendants from enforcing the executive orders. 

On March 5, Plaintiff filed a motion for a nationwide preliminary injunction reasserting their claim that the executive orders violated the First and Fifth Amendments, the Separation of Powers, and the Spending Clause. Plaintiff argued that they faced irreparable harm if the Court were to deny its motion and that an injunction was in the public interest. Defendants filed their memo in opposition to the preliminary injunction motion on March 24, 2025, arguing Plaintiff failed to establish jurisdiction, would fail on the merits, and had not shown irreparable injury due to the EOs. Plaintiff filed their reply to the defendants' opposition to their motion for a preliminary injunction on April 7, 2025, reasserting their previous claims.

On March 18, Plaintiff filed a motion for a temporary restraining order pending the resolution of the preliminary injunction order. The TRO requested the Court preclude “any and all federal agencies from taking action adverse to a federally funded contract, grant, or other implementing vehicle, where that action is animated by the anti-diversity EOs.”

The Court granted in part Plaintiff's TRO request on March 27, enjoining the Department of Labor from blocking contractual obligations to Plaintiff, nor could they require Plaintiff to make any "certification." On April 1, the Court entered an amended TRO order stating that the Department of Labor may not block contractual obligations to Plaintiff where they "act as the primary awardee, grantee, contractor, sub-awardee, sub-grantee, or sub-contractor." Further, the amended TRO order required Plaintiff to provide "the Enjoined Parties a list of all the awards, contracts, and obligations to which CWIT acts as the sub-awardee, sub-grantee, or sub-contractor by March 31, 2025."

The Court granted in part Plaintiffs' preliminary injunction motion on April 14, 2025. The Court found the plaintiffs had standing to challenge the termination and certification provisions in the EO, they had shown a likelihood of success on the merits, and that they faced irreparable harm. The preliminary injunction (1) prevented defendants from terminating Plaintiffs' grant, and (2) prevented defendants from requiring compliance with the certification provision. 

On April 18, Plaintiff filed a motion to modify the preliminary injunction. They requested the court to expand its decision to enjoin the enforcement of the termination provision to all five of CWIT's federally funded grants, rather than just one. The court rejected the motion on May 7, holding that the plaintiffs had "not shown a manifest error of law warranting modification of the preliminary injunction to encompass any of CWIT's other sources of federal funding." Status reports regarding the defendants' compliance with the preliminary injunction are ongoing. The defendants requested the court to stay discovery pending resolution of their motion to dismiss (to be filed on July 7) on June 27. The plaintiffs are to respond to the motion to stay on July 9. 

The case is ongoing.
