This is a case about alleged long-standing race-based pay discrimination in the Mississippi State Senate’s Legislative Services Office (LSO). On November 8, 2024, the U.S. Department of Justice filed this lawsuit in the United States District Court for the Southern District of Mississippi. It sued the Mississippi State Senate under Title VII of the Civil Rights Act of 1964, which prohibits employment discrimination on the basis of race and sought back pay, compensatory damages, and injunctive relief. The case was assigned to U.S. District Judge Henry T. Wingate and was later referred to Magistrate Judge Andrew S. Harris after Magistrate Judge LaKeysha Greer Isaac recused herself.

As alleged in the complaint, the Mississippi State Senate paid a Black attorney in the LSO, significantly less than her white colleagues throughout her eight-year tenure as evidenced by her comparatively lower starting salary and raises given to white colleagues but not to her throughout her employment. Ultimately, although she performed comparable duties and had relevant legislative experience, and despite her raising concerns about her compensation on multiple occasions, the complaint alleged that she was consistently paid less than any of the white attorneys in the office, with annual differences ranging from $40,000 to $60,000. After the employee resigned, she filed a charge of discrimination with the Equal Employment Opportunity Commission (EEOC) in May 2019. The EEOC conducted an investigation, found reasonable cause to believe that she had been subjected to race-based wage discrimination, and referred the case to the Department of Justice for enforcement. The complaint alleged that the Senate’s compensation practices violated Title VII’s prohibition on race-based pay discrimination.

Following a change in presidential administrations, and before the Mississippi State Senate filed an answer or any substantive motions, the government voluntarily dismissed the case without prejudice on April 15, 2025. The case was closed that same day without a ruling on the merits.
