This case challenged the State Department’s new policy of providing transgender Americans with U.S. passports identifying only their sex assigned at birth. This case challenged the State Department’s new policy of providing transgender Americans with U.S. passports identifying only their sex assigned at birth. Plaintiffs, seven transgender U.S. citizens, received passports with sex markers using their sex assigned at birth rather than their gender identity, in some cases after having had the preferred markers for many years or without having filed for passport renewal at all. Plaintiffs alleged the State Department’s passport policy violated the Equal Protection Clause, their Fifth Amendment rights to travel and to privacy, their First Amendment right to free speech, and the Administrative Procedure Act.

On his first day in office, President Trump’s January 20, 2025, executive order mandated that the federal government recognize only two biological sexes and that individuals may only be identified by the sex assigned to them at birth. Since at least 1992, the State Department had allowed individuals to change the gender on their passport to align with their gender identity and provided an option starting in 2021 for non-binary Americans to mark their gender with an “X.” 

Represented by Lambda Legal, the plaintiffs filed this lawsuit on April 25, 2025, in the U.S. District Court for the District of Maryland. The lawsuit sued the U.S. Department of State, Secretary of State Marco Rubio, and the United States. Plaintiffs sought a declaration that the State Department’s policy of recognizing only sex assigned at birth was unconstitutional, an injunction preventing the Department from using sex assigned at birth on U.S. passports, and attorneys’ fees. The case was assigned to Chief District Judge George Levi Russell III.

On May 14, 2025, plaintiffs filed a motion seeking a preliminary injunction.  On July 1, 2025, the court granted defendants' motion for an extension of time to respond to the complaint; defendants will have 30 days from the court's ruling on the preliminary injunction to file their response to the complaint.

On September 9, 2025, the court granted the Preliminary Injunction as to the Equal Protection claim for all plaintiffs except Robert Roe. 2025 WL 2606101. The court held that since the policy applies to all genders equally but only affects transgender individuals, it discriminates on the basis of sex, and thus it must stand up to heightened scrutiny. The court did not reach the question of merits as to their other claims, because they are likely to succeed on the merits of their Equal Protection claim. The court denied without prejudice the remaining counts, and as to Robert Roe, as they held Roe is not likely to succeed on the merits. Roe, who has not yet applied for a passport, does not have standing, the court held.

On Nov. 6, 2025, defendants appealed to the U.S. Court of Appeals for the Fourth Circuit.
