Transgender and nonbinary Americans sued the second Trump administration regarding its new passport policy. This policy was implemented due to Executive Order 14168, "Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government." Plaintiffs are represented by the ACLU and private counsel. They filed this case in the United States District Court for the District of Massachusetts on February 7, 2025. The Executive Order directed the Secretary of State to “implement changes to require that government-issued identification documents, including passports, visas, and Global Entry cards, accurately reflect the holder’s sex” as defined within the order. Under this policy, passports would designate the holder’s sex as that assigned at birth, not the individual's gender identity, and would not allow an “X” gender classification.  

Plaintiffs sued as individuals and also sought certification as a class. Defendants were Donald J. Trump, the Department of State, and the United States. The case was assigned to Judge Julia E. Kobick.  

Plaintiffs claimed that the challenged policy violates the constitutional guarantee equal protection because it discriminates based on sex and transgender status, and also unlawfully infringes upon the right to travel, forces disclosure of private information, and compels the speech of transgender applicants through their passports. They alleged violations of both the Constitution and the Administrative Procedure Act, and sought an injunction and declaratory relief. 

On Feb. 18, 2025, Plaintiffs sought a preliminary injunction.  A motion hearing was conducted on March 25, 2025. 

The court granted the plaintiffs' motion in part, enjoining the enforcement of the passport policy against all plaintiffs except for one, who was found not to suffer irreparable harm due to his existing passport. The injunction mandated that the U.S. Department of State issue passports to the plaintiffs with sex markers corresponding to their gender identities, including the option for an "X" sex designation. This injunction remains in effect until a final judgment is made in the case.

The plaintiffs' request to stay the Passport Policy was denied, and the injunction will remain until further orders from the court or appellate courts.
