(FANM), filed this lawsuit on March 15, 2018, in the U.S. District Court for the Eastern District of New York against President Donald Trump and Department of Homeland Security officials. The plaintiffs challenged the Trump Administration's November 20, 2017 decision to terminate Haiti's TPS designation, which was set to become effective on July 22, 2019. They alleged this decision was motivated by racial animus rather than statutory criteria, citing President Trump's statements that Haitians "all have AIDS" and come from "shithole countries," and argued that extraordinary conditions in Haiti still prevented safe return. The lawsuit raised six claims including violations of the Administrative Procedure Act, Fifth Amendment due process and equal protection, and sought declaratory and injunctive relief to reverse the termination decision.
