These federal funds were disbursed by the Office of Violence Against Women (OVW), a branch of the U.S. Department of Justice (DOJ). Congress expressly included language in the Violence Against Women Act (VAWA) forbidding discrimination based on gender identity; requiring that programs reach racial minorities and other underserved groups; and prohibiting discrimination based on alienage status. The plaintiffs alleged, however, that the Trump Administration ignored these longstanding statutory requirements in favor of vague and broad directives forcing potential OVW grantees to conform to its views to receive funding. The plaintiffs alleged that the Trump Administration's requirements for the receipt of federal funds thus violated the Administrative Procedure Act, the Separation of Powers, the Spending Clause, the First Amendment, and the Fifth Amendment.

The plaintiffs, seventeen official state organizations dedicated to combatting gender-based violence, filed this lawsuit in the U.S. District Court for the District of Rhode Island on June 16, 2025. Among others, the plaintiffs were represented by Democracy Forward and the ACLU. The lawsuit named DOJ, the Attorney General, OVW, and OVW's Acting Director as defendants. The plaintiffs sought a declaration that the defendants acted unlawfully; preliminary and permanent injunctions preventing the defendants from imposing the challenged conditions of funding; and attorneys' fees. The case was referred to District Judge Amy Moses.

The parties agreed to an accelerated briefing schedule. The plaintiffs filed a motion for a preliminary injunction (PI) on June 26, 2025, and a hearing was held on the motion on July 29, 2025. On August 8, 2025, the court granted in part and denied in part the plaintiffs' PI motion. 2025 WL 2271867.

The court concluded that it had jurisdiction to consider a challenge to grant funding conditions, that the decision to adopt the challenged conditions constituted a 'final agency action' appropriate for review, and that imposition of such conditions was not the kind of discretionary agency decision that might otherwise be outside the scope of judicial review. It further determined that, on the present record, OVW's decision to impose the challenged conditions in such a vague and haphazard manner was arbitrary, capricious, and an abuse of discretion.

The court concluded, therefore, that the plaintiffs met their burden to show a likelihood of success on the merits. Moreover, the court determined that the plaintiffs demonstrated the requisite irreparable harm because, absent an injunction, they would have to chose between not accepting needed funds or accepting the funds under conditions that would impede their ability to provide core services. Finding the balance of equities and public interest also in the plaintiffs' favor, the court granted a preliminary stay of the challenged grant conditions on all FY 2025 grants, pursuant to Section 705 of the APA.  Because it concluded that this Section 705 preliminary stay provided all necessary relief, the court denied plaintiffs' application for separate injunctive relief.
