This case challenged President Trump's Executive Order 14168, which targeted transgender individuals and prohibited gender-affirming care in federal prisons. EO 14168 redefined the term "sex" to mean the sex assigned to an individual at birth, rather than an individual's gender identity. Pursuant to this order, prison officials denied transgender prisoners clothing and underwear that matches their gender identity, assigned guards of the opposite gender to search trans prisoners, refused gender-affirming care, and harassed trans inmates regarding their identity. ("You are not a woman! You are a man in a men's prison.") Plaintiff alleged this conduct by prison officials violated the Eighth Amendment, the Equal Protection Clause, and the First Amendment.
Plaintiff, a transgender woman in the custody of the Federal Bureau of Prisons (BOP), filed this lawsuit in the U.S. District Court for the Middle District of Florida on June 20, 2025. The lawsuit named President Donald Trump, the Attorney General, the BOP Director, and various BOP Wardens as defendants. Plaintiff filed this lawsuit pro se. Plaintiff sought a declaration that Trump's executive order was unconstitutional; a preliminary and permanent injunction against the order's enforcement both generally and specifically as applied to plaintiff; and attorneys' fees.
The same day, plaintiff moved for a temporary restraining order or preliminary injunction. The court's decision on that motion is pending.
The case was originally filed in the Orlando Division of Florida's Middle District; it was transferred to the Ocala Division and assigned to Judge Mary Stenson Scriven. Following the transfer, plaintiff filed an amended complaint on July 21, 2025.
On July 30, 2025, the court ordered the prison warden to provide a statement of plaintiff's bank account and recent transactions within 14 days; plaintiff had previously moved to proceed in forma pauperis.
