On December 19, 2025, six Burmese nationals with Temporary Protected Status (“TPS”) brought this putative class action lawsuit in the U.S. District Court for the Northern District of Illinois against the U.S. Department of Homeland Security ("DHS"), DHS Secretary Kristi Noem, U.S. Citizenship and Immigration Services, and the United States. The plaintiffs challenged DHS’s November 25, 2025 decision to terminate TPS for Burma (Myanmar), effective January 26, 2026.

The complaint alleged that DHS violated the TPS statute and the Administrative Procedure Act by predetermining the termination outcome, failing to conduct the required objective country-conditions review, and failing to meaningfully consult with other federal agencies. Represented by the Asian American Legal and Education Defense Fund, International Refuge Assistance Project, and private counsel, the plaintiffs sought declaratory relief, vacatur, postponement, or stay of the termination of TPS, an injunction prohibiting defendants from enforcing the termination, fees, and costs. This case was assigned to Judge Matthew F. Kennelly.

On December 22, 2025, the plaintiffs moved for a preliminary injunction to postpone the agency action, and on January 23, 2026, after argument, the court granted the motion, postponing the effective date of the termination to preserve the status quo pending resolution of the case on the merits. The court reasoned that the plaintiffs had shown a likelihood of success on the merits of their APA claims, citing evidence that the defendants failed to comply with the statutory requirements of consultation and review of country conditions and that the termination was improperly based on pretext. It further concluded that the termination of TPS would cause irreparable harm because the plaintiffs would immediately be subject to arrest and detention pending deportation, and that the balance of equities and the public interest weigh in plaintiffs’ favor. 2026 WL 184544. 

On February 11, 2026, the defendants filed with the district court a motion to stay the preliminary injunction pending appeal, and, the next day, filed a notice of appeal. Judge Kennelly denied the defendant's motion to stay on March 10, 2026, reasoning that the defendants had failed to show a likelihood of success on appeal nor had they established irreparable injury absent a stay.  2026 WL 674343.  

As of March 2026, the lawsuit is ongoing, and plaintiffs motion to certify the class (filed March 3, 2026) remains pending.
