In this class action suit, Plaintiff aims to rectify Home Depot U.S.A’s lack of accessible technology in its cash back transactional process for the blind or visually impaired. Plaintiff lived in Richfield, Minnesota, and frequented the Home Depot location in Bloomington, Minnesota. Home Depot offers its customers who are checking out the option to use a point-of-sale (POS) terminal to pay for their purchase and the opportunity to receive cash back. In these transactions, customers first insert their debit card and are prompted with questions on the screen about how much money they would like to withdraw. However, for blind and visually impaired customers like Plaintiff, they must rely on employees or third parties to complete the transaction on their behalf, putting them at risk of theft or fraud. On July 13, 2023, Plaintiff brought this putative class-action against Home Depot U.S.A, Inc. in the United States District Court of Minnesota. 2023 WL 12032153. The presiding judge for the case was Judge Donovan W. Frank. The putative class is being represented by Throndset Michenfelder, LLC. The plaintiffs sued Home Depot under Title III of the Americans with Disabilities Act, which provides that “no individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of any place of public accommodation.” The ADA stipulates that public accommodations shall furnish the appropriate auxiliary aids and services where necessary to ensure effective communication with individuals with disabilities and protect the virtues of privacy and independence. The Plaintiffs sought declaratory relief and injunctive relief requiring Home Depot to update or replace all POS terminals so they are safely, privately, independently, fully, and equally accessible to blind or visually impaired people.

Judge Frank certified the class on October 6th, 2025. Not long after,  the Plaintiffs and Defendant entered settlement talks. As discovery continued, the parties continued extensive settlement discussions until January 14th, 2026, when Judge Frank granted the Plaintiffs’ unopposed motion for approval of class-wide settlement  and awarded the Plaintiffs attorney fees, costs, and expenses. Per the settlement, the injunctive relief was dropped. As of February 9th, 2026, there is no pending litigation.
