Sean McClary, an African American male residing in Virginia, filed a discrimination lawsuit against Edward C. When the Trump Administration indicated it would eliminate remote work arrangements, McClary filed a formal request for reasonable accommodation for remote work in February 2025, but GSA allegedly refused to process his request. He was terminated on February 14, 2025, ostensibly for poor performance, briefly reinstated due to litigation but placed on administrative leave, then terminated again in August 2025. McClary brings claims under the Rehabilitation Act for failure to accommodate, retaliation, and disparate treatment, as well as a Fourteenth Amendment equal protection claim, seeking reinstatement, compensatory damages of not less than $1,000,000, and additional remedies.
