This case challenges HHS’s FY 2027 Title X funding notice, which requires applicants and grantees to align with new priorities on contraception, marriage and parenthood, abortion-related care, and gender identity, as well as unspecified HHS and OASH priorities. PPFA alleges that these requirements conflict with Title X law and guidance, exceed HHS’s authority, are vague and arbitrary, bypass required notice-and-comment procedures, and fail to give adequate notice of funding conditions.
