On September 13, 2004, the Milwaukee office of the Equal Employment Opportunity Commission filed a lawsuit under Title VII and the Americans with Disabilities Act against Schneider National, Inc. in the U.S. District Court for the Eastern District of Wisconsin. The EEOC alleged that the defendants, who operated a trucking company that ran routes between Green Bay and Racine, had unlawfully refused to allow the complainant, who was a truck driver, to continue driving for their company after he took medical leave for a seizure. The EEOC alleged that this constituted unlawful discrimination on the basis of a disability under the ADA.
On January 20, 2006, the parties filed cross motions for summary judgment. On May 31, 2006, the district court denied the EEOC's summary judgment request but granted the defendant's summary judgment request.
On July 31, 2006, the EEOC appealed the district court's decision. On March 21, 2007, the U.S. Court of Appeals for the Seventh Circuit affirmed the district court's decision, and on May 22, 2007 the Seventh Circuit denied the EEOC's request for a rehearing en banc.
